A lawsuit resulted. In connection with a settlement agreement not yet approved by the court, the City changed the zoning to C, Commercial in late 1995. On May 14, 1996,, City Council approved both the Planned Development Commercial zoning and the preliminary plat. TRANSPORTATION: MacArthur Boulevard is a four-lane divided thoroughfare built a l l0'-wide right-of-way shown on the thoroughfare plan as a P6D, 6-lane divided thoroughfare. DISCUSSION: This final plat agrees with the approved preliminary plat and the planned development commercial zoning application. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Staff recommends approval of the final plat subject to the following condition being met: 1) Submit an irrigation plan for Lot 2, the common landscaped area, which is signed and sealed by a licensed irrigator. Impact fees must be paid prior to the submission of the Final Executed Plat. Also, the plat needs to be filed for record with Dallas County before issuance of a building permit.
