A lawsuit resulted. In connection with a settlement agreement not yet approved by the court, the City changed the zoning to C, Commerical in late 1995. On May 14, 1996, City Council approved both the Planned Development Commercial zoning and the preliminary plat. TRANSPORTATION: MacArthur Boulevard is a four-lane divided thoroughfare built in a 110'-wide right-of-way shown on the thoroughfare plan as a P6D, 6-lane divided thoroughfare. DISCUSSION: The final plat, the site plan, and landscape plan all agree with the approved preliminary plat and planned development commercial zoning application. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: Staff recommends approval of this final plat subject to the following conditions being met: 1) The Site plan showing the proposed landscaping on the property must be signed and sealed by a licensed landscape architect or bonafide nurseryman. 2) Submit an irrigation plan signed and sealed by a licensed landscape irrigator. Impact fees must be paid prior to the submission of the Final Executed Plat. Also, the plat needs to be filed for record with Dallas County before issuance of a building permit.
