HISTORY: In 1994 the City reclassified the zoning of this property from "MF-2"
Multi-Family Residential to "R" Retail. A lawsuit resulted. In connection
with a settlement agreement not yet approved by the court, the City
changed the zoning to "C" Commercial in late 1995. The applicant
platted the property adjacent to the north in 1996. City Council approved
the preliminary plat for this additional property on March 11, 1997.
TRANSPORTATION: MacArthur Boulevard is a 4-lane divided thoroughfare built in a
110'-wide right-of-way shown on the thoroughfare plan as a P6D,
6-lane divided thoroughfare.

COMPREHENSIVE PLAN: The Comprehensive Plan shows the property suitable for
regional retail uses.
DISCUSSION: The final plat conforms with the preliminary plat which the Planning and
Zoning Commission approved February 20 and which City Council
approved March 11, 1997.
RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
The planning staff recommends approval of the final plat subject to
Engineering Department comments.
