A lawsuit resulted. In connection with a settlement agreement not yet approved by the court, the City changed the zoning to "C" Commercial in late 1995. The applicant platted the property adjacent to the north in 1996. TRANSPORTATION: MacArthur Boulevard is a 4-lane divided thoroughfare built in a 110'-wide right-of-way shown on the thoroughfare plan as a P6D, 6-lane divided thoroughfare. Item # 14 SURROUNDING LAND USE & ZONING: North - Commercial development; PD-C zoning South - Undeveloped; C zoning East - Commercial development; R zoning West Transmission line and undeveloped; A and TH-1 zoning COMPREHENSIVE PLAN: The Comprehensive Plan shows the property suitable for regional retail uses. DISCUSSION: The site plan, as proposed, does not conform with the landscaping area requirements specified in Section 34 of the Zoning Ordinance. The areas required are tabulated as follows: Non-vehicular landscaping (z,6 or more in front) - 21,164 s.f. Landscape buffers for the vehicular use areas _ 16,700 s.f. Interior parking lot landscaping - 10% of paved area The site plan shows a 30,000 s.f. building surrounded by 8,300 s.f. of sidewalk. The first two lines of the table above shows nearly 38,000 s.f. of required landscaping. Out of a 178,621 s.f. site, this leaves approximately 102,500 square feet of land available for driveways, parking and parking lot landscaping. Therefore, parking and drives cannot exceed 93,200 s.f. The parking and drives on the site plan submitted appear to have an area of 98,420 s.f. RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION: The planning staff recommends approval of the preliminary plat subject to Engineering Department comments and revision of the site plan to conform with Section 34 of the Zoning Ordinance.
