LETTER OF PERMISSION
That, CP-COPPELL INDUSTRIAL, LTD., the undersigned, does hereby grant
to the City of Coppell or its employees, engineers, or contractors, permission to enter
the property owned or controlled by them, being further described as the remainder of
that certain tract conveyed to CP-COPPELL INDUSTRIAL, LTD., and TES-VERGIL
AVENUE, LTD., as recorded in Volume 2000093, Page 4346 of the Dallas County
Deed Records, Dallas County, Texas, for the purpose of constructing side-slopes for
the proposed Creekview Drive and Freeport Parkway Project (ST 00-01). This Project
consists of the construction of approximately 2800 linear feet of a new four-lane
undivided roadway, the reconstruction of approximately 500 linear feet of Freeport
Parkway from a two-lane roadway to a four-lane divided roadway, drainage
improvements, sidewalks, ramps, and the installation of approximately 2800 linear feet
of 12-inch water line and 500 linear feet of 8-inch water line. The construction of this
Project is anticipated to begin in October 2001 with an estimated construction time of
15 months. The work on said property generally consists of 4:1 slope grading
necessary to tie the proposed finished ground elevation into the existing ground
elevation, as shown on the attached plan-profile sheet(s). This Letter of Permission
includes the right to move equipment onto the property that is necessary for the slope
grading and the right of reasonable ingress and egress across the property for the
construction purposes.
The City of Coppell will also restore the land back to its original condition to
the maximum extent practicable. Where sod, shrubbery, and plants are removed
during the construction, such areas will have the same sod, shrubbery, and plants
replaced in their prior positions. Any trees that are to be removed and subsequently
replaced are designated on the plan-profile sheet(s).
