COUNTY OF DALLAS § KNOW ALL MEN BY THESE PRESENTS: That STEED, INC. , as Principal, and FEDERAL INSURANCE COMPANY , a corporation organized under the laws of the State of New Jersey , as Surety, do hereby expressly acknowledge themselves to be held and bound to pay unto the CITY OF COPPELL, TEXAS~ Post Office Box 478~ Coppell, Texas 75019 , a municipal corporation, the sum of ---Twenty-One Thousand, Nine Hundred Ten and no/100--- Dollars ($ 21,910.00--- ) for the payment of which sum well and truly to be made unto said the CITY OF COPPELL, TEXAS and its successors, said Principal and Surety do hereby bind themselves, their assigns, and successors jointly and severally. The condition of this obligation is such that said STEED, INC. has entered into a written contract dated the 7th day of December , 1987 with McDONALD'S to build and construct the sanitary sewer extension in Sandy Lake and Denton Tap Road to serve McDonald's in Coppell, Texas which contract and the plans and specifications therein mentioned and adopted by the CITY OF COPPELL, TEXAS , are hereby expressly made a part thereof as though the same were written and emodied herein. WHEREAS, under the specifications and contract, it is provided that the Principal shall maintain and keep in good repair the work constructed and/or equipment furnished by him as contemplated by the plans, specifications, drawings, etc., and perform for a period of one ( 1 ) year(m) from the date of acceptance or the date of final payment, whichever bears the later date, all necessary repairs, reconstruction and re- newal of any part of said construction, and to furnish the labor and materials to make good and to repair any defective condition growing out of or on accounts of the break- age or failure of any substance or the improper function of any part of the construction work. NOW, THEREFORE, if said Principal shall keep and perform its said agreement to maintain said work and keep the same in good repair for the said maintenance period as provided above, then these presents shall b~ null and void and have no further effect; otherwise, to remain in full force and effect. It is further understood and agreed that this obligation shall be a continuing one against the Principal and Surety hereon, and that successive recoveries may be had hereon for successive breaches until the full amount shall have been exhausted; and it is further understood that the obligation herein to maintain said work shall continue throughout said maintenance period, and the same shall not be changed, diminished, or in any manner affected from any cause during said time.
