Dear Mr. Pfiddy:
This letter is written concerning the approved construction time for Sandy Lake Road from Denton Tap to
MacArthur Blvd. The original bid on this project was for 850 Days. Since the original bid, there have
been seven change orders on this project. Those seven change orders added 205 Days to the construction
time for a total completion time of 1055 Calendar Days (Change Order ltl - 14 Days, Change Order it2 -
27 Days, Change Order it3 - 0 Days, Change Order it4 - 30 Days, Change Order it5 - 120 Days, Change
Order it6 - 14 Days, and Change Order it7 - 0 Days).
This project was bid on a calendar day basis. Based on your last pay estimate for work through July 31,
2001, it was noted that there were 1017 Days used to date. As of September 7, 2001 the Calendar Days
on this project will expire. The definition ora Calendar Day is any successive day of the week or month,
no days excepted.
Therefore, as of September 8, 2001 the City will begin assessing $500/per day liquidated damages on this
project until such time as the project is substantially complete.
With this letter, I am also requesting that you provide an updated project schedule for the substantial
completion of this project. If you should have any questions or need additional clarification please feel
