I have read the material as referenced above and reviewed this with
Steve Morton. I have no objections with you processing the tenant
construction application. Are you sure that the City must process
said application? In discussing this with Steve Morton it appears
that in the past, applications were processed by DFW.
In regard to the 60 day notification as we read the license with DFW,
it would appear to be more of a license breach condition that a general
condition.
True, tenants continguous to Royal Lane South would theorectically
be cut off from access if the roadway was closed by DFW. However,
staff's opinion is that since the surrounding property falls within
the DFW authority limits, and any development contemplated would have
to receive approval from DFW before development could commence and
subsequent approval by the City of Coppell, there appears to be at
least 2 points where this license agreement can and should be identified.
