Denton Tap Road Coppell, TX 75019 RE: Grapevine Creek III Sanitary Sewer Project #SS94-02A Dear Mr. Fikes: This letter is written as a follow-up to our meeting concerning the acquisition of the utility easement across the eastern side of your property located at 794 S. Denton Tap Road, generally referred to as Northlake Nursery and Landscaping Company. The Engineering Department has again analyzed the survey information. The analysis of the actual areas impacted is as follows: Area 1- The northern portion of the sewer line encroaches further into the property encumbering approximately 6,874.98 square feet of what could have previously been developed. Area 2- The southern portion of the sewer line encroaches further into the property encumbering approximately 2,447.77 square feet of what could have previously been developed. Area 3- The middle section of the sewer line generally is behind what was the location of the original sewer easement. This in turn creates more developable area in the middle of the property. That new easement in the middle of the property is 3,758.2 square feet. Area 4- By virtue of the middle section of the sewer line being located behind the original easement, approximately 3,131.11 square feet of the existing utility easement can be reclaimed in the future for development purposes. In considering the above information, the following is the City's offer: > Areas 1 and 2 constitute 9,322.75 square feet and the City is offering $5.50/per square tbot for that area. Area 3 is strictly an easement area of 3,758.2 square feet of which the City is offering $1.38/per square foot for that area. Area 4 is a reclaimable and hence developable area of 3,131.11 square feet valued at $5.50/per square foot. 9322.75 x 5.50 = 51275.13 3758.20 x 1.38 = 5186.32 56461.45 3131.11 x 5.50 - 17221.11 39,240.34 Total Value As all parties are aware, the resolution of this issue has gone on for some time now. In an effort to resolve the issue, the City of Coppell is offering $40,000 for the 20-foot utility easement as described in Exhibits A and B. Exhibit A is the actual legal description and Exhibit B is the exhibit showing that legal description. The grand total of that utility easement is 15,214.58 square feet. Exhibit C shows Areas 1, 2, 3 & 4 previously alluded to in this letter. At such time as the property redevelops, the City of Coppell would allow the abandonment, by virtue of platting, of the 3,131.11 square feet referred to as Area 4 in this letter. If this offer is acceptable to you please sign below and return to me. Once I have received the letter, I will start the process for payment of $40,000. When the check has been processed we can arrange a mutually agreeable time to meet to notarize the new easement document in exchange for the check.
