STAFF COM1~ENTS:
My office has been approached by the owner of the property at 145 Meadowcreek Road (Lot 22, Block B
Northlake Woodlands Section V) seeking approval to encroach into an existing sanitary sewer easement. The
easement in question contains a 12" sanitary sewer line. Council may recall that numerous residents along
this section of Meadowcreek Road have in years past encroached into the same sanitary sewer easement,
some have even built pools directly over our sewer line. The owner was informed that an encroachment
would not be allowed. However, depending on the actual location of our sewer line, we may consider
abandonment of a portion of the easement.
Upon investigation, it was determined that our sanitary sewer line is not centered within the existing 20-foot
easement. In fact, it was further away from his house than shown on the plans. The abandonment of a
portion of the 4-foot on the house side of the easement in lieu of the dedication of a 4-foot portion on the
back side of the easement actually will mean our existing 12" sanitary sewer line will be centered within the
new 20-foot sanitary sewer easement.
Staff supports the abandonment of a 4-foot strip of the existing 20-foot easement and the rededication of a 4-
foot strip adjacent to the 20-foot sanitary sewer easement. Staff will be available to answer any questions at
the Council meeting.

AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
ABANDONING AN EXISTING 4' SANITARY SEWER EASEMENT
LOCATED ON LOT 22, BLOCK B OF THE FIFTH SECTION OF
NORTHLAKE WOODLANDS ADDITION, AS DESCRIBED IN
EXHIBIT A ATTACHED HERETO, IN EXCHANGE FOR AN
ALTERNATE 4' SANITARY SEWER EASEMENT LOCATED ON
LOT 22, BLOCK B OF THE FIFTH SECTION OF NORTHLAKE
WOODLANDS ADDITION, AS DESCRIBED IN EXHIBIT "A"
ATTACHED HERETO, PROVIDING THAT SAID ORDINANCE
SHALL CONSTITUTE A QUITCLAIM DEED THAT MAY BE
RECORDED WITH THE COUNTY CLERK OF DALLAS COUNTY
TEXAS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Coppell desires to abandon a four (4')
sanitaxy sewer easement located on Lot 22, Block B of the Fifth Section of Northlake
Woodlands Addition in the City of Coppell, Texas and more particularly described in
Exhibit "A" attached hereto as L-1 through L-4; and
WHEREAS, in consideration thereof the City Council desires to accept an alternate
four (4') foot sanitary sewer easement located on Lot 22, Block B of the Fifth Section of
Northlake Woodlands Addition in the City of Coppell, Texas and more particularly
described in Exhibit "A" attached hereto as L-5-L-8;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF COPPELL, TEXAS:
SECTION 1. That the City Council of the City of Coppell, Texas finds and has
determined that the existing four (4') foot sanitary sewer easement located on Lot 22, Block
B of the Fifth Section of Northlake Woodlands Addition in the City of Coppell, Texas and
more particularly described in Exhibit "A" as L-1 through L-4, attached hereto and made a
part hereof for all purposes, is no longer needed or necessary for public purposes and should
be, and is hereby, abandoned in exchange for the dedication of an alternate four (4') foot
sanitary sewer easement within Lot 22, Block B of the Fifth Section of Northlake
Woodlands Addition in the City of Coppell, Texas and more particularly described in
Exhibit "A" as L-5 through L-8, attached hereto and incorporated herein by reference as if
set forth in full.
SECTION 2. That the passage of this ordinance and execution of a separate
instrument alternate four (4') foot sanitary easement thereof to the City shall constitute
acceptance described as L-1 through L-4 of Exhibit A in favor of the property owner of the

property of Exhibit A, and a certified copy of the same may be filed in the Deed Records of
Dallas County, Texas, to indicate such abandonment.
SECTION 3. That upon acceptance and passage a Quitclaim of this Ordinance
shall be and constitute Deed.
SECTION 4. That the abandonment provided for herein shall extend only to
the public right, title and interest which the City of Coppell, Texas, may have in and to said
utility easement, and shall be construed to extend only to such interests that the governing
body of the City of Coppell, Texas, may legally and lawfully abandon.
SECTION 5. That this ordinance shall become effective from and after its
passage as the law and charter in such case provide.
