Paragon Cable approves the encroachment listed above. Paragon Cable agrees that the applicant
has the right to use public utility easements in methods that do not conflict or interfere with
Paragon Cable's uses of its easement fights. However, should applicant's use ultimately result in
an interference to Paragon Cable's uses, then applicant, its successors and assigns understand, as
a matter of law, that it is required to remove such portion of any structure interfering with
Paragon Cable's easement uses. Should Paragon Cable be required to remove any structure or
portions thereof to repair, replace or install utilities, the applicant, its successors and assigns
understand that applicant may be required to replace such structure or portion thereof at their
own expense.

Lone Star Pipeline Company has no objection to the proposed abandonment of the 7.5 foot
utiliU' easement at the back of this proper~~. It is understood that the abandonment will have
no effect on the pipeline easement on the east side of the properW, running north and south,
through which runs an eighteen-inch natural gas pipeline owned and operated by Lone Star
Pipeline Company. The 7.5 foot utility easement overlaps the pipeline easement at the
northeast corner of the property.

BUILT IN 1986 BY ROBERTSON'S POOLS IS ENCROACHING INTO THE 7.5'
UTILITY EASEMENT ON THE REAR PROPERTY LINE, AMERICAN TITLE
COMPANY IS HANDLING THE CLOSING OF THE ABOVE REFERENCED
PROPERTY, WHICH WAS TO HAVE BEEN FRIDAY, MAY 22, 1998.
AT THE SUGGESTION OF AMERICAN TITLE COMPANY, WE ARE WRITING THIS
LETTER TO REQUEST THAT THE CITY OF COPPELL GRANT US AN
ABANDONMENT OF THAT PORTION OF THE EASEMENT THAT LIES WITHIN THE
EASEMENT. IT IS OUR UNDERSTANDING THAT YOU WILL NEED A LEGAL
DESCRIPTION OF THAT PORTION OF THRE EASEMENT TO BE ABANDONED, AS

THE SQUARE FOOTAGE OF THE ABANDONMENT.
WE HAVE RECEIVED A LETTER FROM TU ELECTRIC AND LONE STAR GAS,

HAVE BEEN VERBALLY CONTACTED REGARDING THE ENCROACHMENT AND

Dear Mr. McKinney:
This letter is to advise that Texas Utilities. Inc., representing TU Electric and
Lone Star Gas Company, has no objection with respect to the existence of a swimming
pool located within the Utility Easement on the North fence line of 552 Briarglen Dr. on
the date hereof.
1. Subject to the terms hereof. Texas Utilities consents to the encroachment of the
Easement as described above.
2. Owner acknowledges that Texas Utilities' consent will automatically terminate
if and when: (a) the encroachment of the Improvements on the Easement shall fail to
conform with all applicable safety standards and electrical codes, laws, ordinances and
regulations from time to time in effect, or (b) in the sole judgment of Iexas Utilities, the
encroachment of the Improvements on the Easement shall impair, endanger or interfere
with the construction, efficiency or convenient operation and maintenance Texas Utilities'
present or future facilities located within the Easement. Texas Utilities shall provide
owner with written notice of the termination of its consent.
3. Texas Utilities' consent shall not extend, directly or by implication, to any
building, fence, tree, shrub or other structure, improvement or other growth of any kind
or character, whether permanent or temporary (collectively, "Other Improvements") other
than the Improvements and Owner expressly agrees not to place any Other Improvements
on the Easement.
4. Owner agrees that upon termination of Texas Utilities' consent, Owner shall.
within sixty (60) days of Texas Utilities giving of written notice thereof, either, at Texas
Utilities' option, (a) remove the Improvements from the Easement (at Owner's sole
expense) or (b) reimburse Texas Utilities for all reasonable costs of removal and
relocation of its electrical or gas facilities located on the Easement.

5. Texas Utilities shall continue to have the unrestricted access to, on and across
the Easement.
6. Owner acknowledges and understands that Texas Utilities maintains overhead
and/or underground electrical facilities within the easement. Owner agrees to exercise
extreme caution with respect to such electrical facilities.
7. Owner agrees to and shall indemnify, hold harmless and defend Texas
Utilities, its officers, agents and employees, from and against any and all claims.
demands, losses, costs, damages, causes of action, suits and liability of any kind.
including all reasonable expenses of litigation, court costs and attorneys' fees. for injury
to or death of any person, or for damages to Owner's property or to any other property,
arising out of or in any way resulting, directly or indirectly, from or incident to any
activity, circumstance or condition connected with, Owner's use of the Improvements on
the Easement, the operation or existence of Texas Utilities' facilities on the Easement or
their proximity to the Improvements or Texas Utilities' failure to cause Owner to remove
the Improvements, including, but not limited to, such claims, demands, causes of action,
suits and liability resulting from the sole or concurrent negligence, strict liability or other
fault of Texas Utilities.
