The City has been approached concerning its ability to allow the existing improvements within
a twenty foot drainage and utility easement to remain or abandon the twenty foot drainage and
utility easement located on the east side of 526 Rolling Hills Ddve. Apparently, a pool was
built in 1980 along with a storage building and a pump facility. The City has reviewed its plans
and found that we have no utilities in the existing easement. The City is currently in the process
of contacting the various franchise utility companies to ascertain whether or not they have
existing facilities in the easement. If there are no existing, facilities within the easement, then
the City will support the abandonment of the existing easement. However, if one of the
franchise utility companies is utilizing the easement, then the City would have to work out an
alternative strategy to allow the existing encroachments in the drainage and utility easement to
remain.
In no ease will the City require the removal of the existing improvements.
I will be in contact with you concerning whether or not tl~e easement can be abandoned after I
have contacted all the franchise utility companies. If it cannot be abandoned, then the City will
work out an alternative solution to allow the encroachments to remain.

American Title Company requests that the City of Coppell issue a non-
condemnation letter, stmtlar to the one enclosed herewith, regarding
the extstlng pool and other structures that are located within the
20' drainage and utility easement on the rear of the property. The
pool vas built in 1980, and Ray Gonzales of the Public Works Department
has determined that there are no utilities or sewer or drainage pipes
located within the easement.
AHER/CAH TITLE COMPANY requests that the City Council, at its special
meeting on March 16, get a consensus of council so that this letter
request will be brought before the Council on their next regular meeting
on March 22, 1994.
It ts our understanding that the Council has granted s/m/lar requests
to other homeowners in the City of Coppell and that we can have the
assurance that the same consideration will be given the homeowner at
526 Rolling Hills in Coppell.

The by-laws for our Board of Adjustment provide that staff may release, (prior to the Zoning
Board of Adjustment hearing the case), a non-condemnation letter if the structure in question
has existed for a period of time and the structure is changing hands. In this case, the property
is being sold.
The Cit7 of Coppeil acknowledges that an encroachment has occurred and the City does not
intend to condemn the structure or initiate a lawsuit to correct the violation.
