Doyle, P.E., City Engineer RE: EASEMENT DISPUTE/612 BETHEL SCHOOL ROAD/ATTACHED 7/7/89 MEMO The last paragraph of the attached memo dated July 7, 1989, from Greg Jones to Dale Jackson, refers to meeting with me to deal with the drainage easement. Attached is a copy of the relevant portion of the plats for these two lots in question. The drainage easement provided as shown on these plats from the Tax Department, (no title search was done), is 20 feet in width, and is on the lot that fronts on Briarglen (i.e. Lot 19 of Phase 3). There are no other indications on the "as-builts" on file for this subdivision development that would provide direction regarding grading and specifications to guide anyone in the direction of your question in that last paragraph on the attached memo. Perhaps the building permit files would provide what was approved for grading plans, etc... Please feel free for you or your staff to contact me further on this or any other matter, and a meeting can be set to provide adequate attention to the matter. Please be advised that if you nor the citizens have any more information, than what appears to be available, this office cannot have any engineering done (i.e. determine the needed capacity on private property) unless directed in writing by the City Manager. (And this is not advisable). ! would suggest these backyard fences are a civil matter and should be handled that way while the City could be a facilitator, etc... Over lot drainage continues to be a concern in our industry. Ordinances can be adopted; however, enforcement and control are then needed or the ordinances are of no use. Attached are two such ordinances. (Perhaps a survey can be conducted to get some local material?) What may be needed in this case, and perhaps with the numerous cases of variances before the Board of Adjustments, is more control on the building permit process, and submittal of as-builts, etc.., before CO's are granted. This has been discussed also during the TWC meetings with Dale Jackson on their CAV for Floodplain Management. Please let me know if I can be of further service. Thanks.
