Minutes of October 6,1988 The Board of Adjustments of the City of Coppell met in regular called session on October 6, 1988 in the City Council Chambers located in the Town Center, 255 Parkway. The following members were present: Ellen Fugett, Vice Chairman Carl Thompson, Commissioner Lanny Mayo, Commissioner Michelle Lewis, Alternate Bill Hayes, Alternate Also present were: Dale Jackson, Building official Pat Bond, Secretary The following members were not present: Marry Welsh, Chairman Charles ~mhert, Commissioner Vice Chairman Fugett called the meeting to order. Commissioner Thompson gave the invocation. ITEM 3: Commissioner Mayo made a motion to approve the minutes of JulyT, 1988 as read. Commissioner Thompson seconded the motion. The motion carried with a unanimous vote (5-0). ITEM 4: Public hearing to consider request for variance from Section 8.2 1 (b) of City's Zoning Ordinance which concerns side yard setbacks. This variance is being requested by James Hadsell, for the property located at 809 Thweatt Road. James Hadsell made the presentation. He stated that an existing trailer had been removed from that location approximately five years ago and he wanted to replace the old trailer with the new modular home. The modular home was to be used as servants quarters to house Mr. Hadsell's maid. Vice chairman Fugett opened the public hearing for anyone to speak for or against the variance request. No one spoke for or against the requested variance. Vice Chairman Fugett then closed the public hearing. After much discussion Commissioner Hayes made a motion to approve the variance as requested. Commissioner Mayo seconded the motion. The motion carried with a-vote of 4-1 with Commissioner Thompson casting the dissenting vote. ITEM 5 Public hearing to consider request for variance from Section 34.5 1 (c) of the City'~ Zoning Ordinance which concerns se~ck requirements for accessory building. Rick Welsh made the presentation. Mr. Welsh informed the board that the subject structure was a playhouse the he had built for his daughter. He admitted that the playhouse does encroach into the ten foot rear setback that is required for the accessory bUilding; however, the majority of the home owners in his neighborhood did not object to the fact that the playhouse was located adjacent to the rear property line. The property owners that did have objections concerning the accessory building were disturbed by the height of the building. However, the height of the playhouse does comply with current ordinances. If the building was moved to meet the setback requirements, the building would be just as high and visible as it was when it did not meet the setback requirements. Vice Chairman Fugett opened the Public Hearing. Lisa Van Ostrand of 410 Glencrest spoke against the variance request. She stated that she resided directly behind Mr. Walsh's home and that the playhouse is directly adjacent to her rear fence. She also stated that the playhouse creates a psychological affect concerning her privacy and is negatively affecting her attempts to sell her home. Doug Close of 408 Glencrest also spoke against the variance request. He stated that he was not affected by the playhouse; however, he was concerned that current city ordinances allow accessory buildings to be as much as thirty-five feet in height. Four letters written by adjacent property owners were also submitted to the board. Vice chairman Fugett closed the Public Hearing. After discussion among the board members, Commissioner Mayo made a motion to approve the variance to allow the playhouse to be located approximately eighteen inches from the rear property line. Commissioner Hayes seconded the motion. The motion carried (4-1) with Commissioner Thompson casting the dissenting vote. ADJOURNMENT Ellen Fugett, Vice Chairman Pat Bond, Secretary
