Overpayment of Construction Inspection Fees

It has recently come to my attention that inspection fees have been paid for Northlake
Woodlands East gl0B. I have done extensive research on this particular subdivision dating back
to fees paid in December, 1985. The brief history is that the original intent was to develop all
of the property in 1985 and hence fees were paid based upon that intent. Once it became
apparent that the developer would not develop all of the property, they requested a refund of
some fees associated with the undeveloped land. That request was rejected.
In 1993, I did extensive research of the status of the fees and attempted to ascertain how much
would be applied to the existing construction and what remaining credit would be applied to
various other phases. That information was provided with our request for payment of
development fees. That information showed there would be a credit for street lights and
inspection fees. The developer will receive a 100% credit for street light fees and there will also
be a remaining credit of $4,494.40 for future phases to off-set street light fees. The developer
should have also received a credit of $9,764.49 for inspection fees. However, they paid
construction inspection fees totaling $14,231.03 in two separate payments ($301.60 on 3/29/94
and $13,929.43 on 4/26/94).
If you subtract the credit due, which was $9,764.49, from the total amount of inspection fees
due, which was $14,231.03, the total fee we should have collected was $4,466.54. If you
subtract that from the amount he paid, you arrive at the $9,764.49 credit that was due him.

To rectify this matter, a check in the amount of $9,764.49 should be issued. The cash receipts
