See Exhibit A. The right-of- way will be the back of curb, as was the case in developing Town Center Boulevard. The sidewalk along the south side of the boulevard, to be constructed by the City at the time of TCW construction will be within a 10' sidewalk and utility easement. The construction of all water, sanitary sewer and storm sewers facilities will be included within the street R.O.W. to avoid the property owner having to bore or tear out paving section in the future. Ken Griffin agreed that the parkway on the north side of the road will be 10' in width. Due to the shape of the property, the face of buildings, other than adjacent to Demon Tap Road will probably face TCW. The parking lots for those buildings will be predominately east and west of each building, therefore, we need to be allowed to have a series of driveways penetrating into TCW. The City will include water, sanitary sewer and irrigation conduit crossings to their plan. The property owner will reimburse the City the contractors installation cost of construction, however, the owner will review and approve the bids prior to agreeing to said construction of items that the owner is obligated to reimburse. It is traderstood that by dedication of the right-of-way, the property owner, assigns or successors will not be required to pay for any of the roadway improvements. I assume that you have discussed this situation with the City Council. Please let me know of any comments. Hopefully this matter can be processed in an expeditious manner. Sincerely, William A.
