Ms. Taryon Bowman City of Coppell The meeting was held on Friday, March 6, 1987 at 10:00 a.m. at the Coppell Town Center. The purpose of this meeting was to discuss the channelization project for Northport Addition. ITEMS DISCUSSED: 1) Mr. George opened the discussion by stating that the intent of this meeting was to discuss the channelization of Northport Business Park, and to receive some direction from the City Staff as to how to proceed with the extension of a preliminary plat. Plans were presented at this meeting to show the area in which the channel improvements will occur. Mr. George also stated that an agreement needs to be reached between the City of Coppell and the City of Grapevine prior to the final plat of Northport Business Park. 2) The grading plan that was presented at this meeting, will be revised prior to resubmittal of the preliminary plat to the Coppell Planning and Zoning Commission and the Coppell City Council. 3) Mr. Favre suggested that before the City of Coppell takes control of the channel, the developer maintain the channel until their one-year maintenance period expires. If the proposed channelization increases the velocity of flow (greater that 8' per second) the channel must be concrete lined. 4) The Coppell Engineering Department and Ginn, Inc. (Consulting Engineers for the City of Coppell) do not foresee any problems with the channelization being made prior to the final platting procedure; but Staff approval will be required prior to any construction of the channel. Please submit a copy of the Hydraulic Analysis for Cottonwood Creek to Shohre Daneshmand. 5) The Northport Business Park preliminary plat, which will expire on March 10, 1987, will be placed on the Coppell Planning and Zoning Commission docket for Thursday, March 19, 1987. Twenty-two sets of plans and a letter requesting an extension for the preliminary plat, must be submitted to the Planning Department prior to Wednesday, March 11, 1987 at 12:00 noon. Plans to be submitted to the City Council are due on Friday, March 20, 1987 at 1:00 p.m. if the Planning and Zoning Commission requires any changes to be made. If all requirements are met, this item w~ll be placed on the Coppell City Council Docket for March 24, 1987 at 7:30 p.m. 6) The City Staff will take the necessary steps to expedite the agreement between the City of Coppell and the City of Grapevine. Having no further business to discuss, the meeting was adjourned. Y / A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, SETTING THE TERMS OF AN AGREEMENT BETWEEN THE CITIES OF COPPELL, TEXAS AND GRAPEVINE, TEXAS, FOR MUTUAL ASSISTANCE IN THE PROVISION OF UTILITY SERVICES TO A DEFINED AREA BORDERING WITH THE CITY OF GRAPEVINE, TEXAS. WHEREAS, it has been found that a portion of the corporate limits between the Cities of Coppell and Grapevine lies along the Dallas and Tarrant County boundary line, and no physical delineation exists along such portion of said corporate limits; and, WHEREAS, it has been found that the natural gravity flow of sewage collection service within such surrounding area is eastward into the City of Coppell; and, WHEREAS, it has been found that a sanitary sewer collection line of sufficient capacity to serve a portion of the City of Grapevine presently exists within the City of Coppell within approximately 600 feet of said corporate limit; and, WHEREAS, it has been found that the adequate provision of sanitary sewer collection service to such area by the City of Grapevine would not be economically feasible at this time based on the need generated by the amount of development within such area; and, WHEREAS, it has been found that the City of Grapevine has water distribution facilities existing within the immediate area with sufficient capacity to serve a portion of the City of Coppell; and, WHEREAS, it has been found that the City of Coppell has neither water distribution or water storage facilities within approximately 7,200 feet of said corporate limits; and, WHEREAS, it has been found that the adequate provision of water distribution service to such area by the City of Coppell would not be economically feasible at this time based upon the need generated by the amount of development within such area; and, WHEREAS, it has been found that development has been proposed for the immediate future within such area, said development lying within both the Cities of Coppell and Grapevine; and, WHEREAS, it has been found that it would be to the mutual benefit of both cities to agree to mutually assist the provision of utility services to such area. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1 - It is agreed that when Connell Development Company, the present owner of the property known as Airport Business Park, which is to be served under this mutual assistance agreement, shall construct at its sole expense all lines and other necessary improvements, both on site and off site, to connect with existing sewer mains within the City of Coppell and has paid to the City of Coppell as prorata charge the amount of $400.00 per acre, the City of Coppell will allow to be provided, sanitary sewer collection service to that area of approximately 85 acres lying within the City of Grapevine as indicated on Exhibit "A" attached and made a part hereto. SECTION 2 - It is agreed that when Connell Development Company, shall construct at its sole expense all lines and necessary improvements, both on site and off site, necessary to connect with the City of Grapevine water distribution system and has paid to the City of Grapevine a prorata charge in the amount of $400.00 per acre, the City of Grapevine will allow to be provided, water distribution service to that area of approximately 73 acres lying within the City of Coppell as indicated on Exhibit "A" attached and made a part hereto. SECTION 3 - It is agreed that the Cities of Coppell and Grapevine will develop a method for exchange of information necessary for adequate accounting and monthly billing for water and sanitary sewer services for the respective areas, such method to be acceptable to each City Council and approved by the City Manager of the City of Grapevine and the City Administrator of the City of Coppell. Said monthly billing shall be at such prevailing rate as shall be from time to time established by the city furnishing such service. SECTION 4 - The provisions of this agreement may be canceUed, changed or modified by mutual agreement between the City of Grapevine and the City of Coppell and the land area covered by this agreement may be expanded to include other areas by mutual consent of both cities. In the event the City of Grapevine shall hereafter determine that it is economically and physically feasible for it to serve said area which lies within its corporate limits with sewer service, it shall have the right to relieve the City of Coppell from its obligation to serve such area, as may have been undertaken by this agreement, and assume such service to the area. Provided, however, any cost of such change over shall be at the expense of the City of Grapevine and not at the expense of the City of Coppell. In the event the City of Coppell shall hereafter determine that it is economically and physically feasible for it to serve said area which lies within its corporate limits with water service, it shall have the right to relieve the City of Grapevine from its obligation to serve such area, as may have been undertaken by this agreement, and assume such service to the area. Provided, however, any cost of such change over shall be at the expense of the City of Coppell and not at the expense of the City of Grapevine. SECTION 5 - It is agreed that at some future date the two cities will provide for an emergency interconnect between the water distribution systems of the two cities, the date, place and manner of providing such interconnect to be determined by mutual agreement between the two cities and approval by the City Manager and/or City Administrator of each city. SECTION 6 - This agreement shah become effective from and after the date of its passage, except that it shall not become effective unless and until the passage of a Resolution by the City Council of the City of Grapevine, Texas, agreeing to the identical terms of this Resolution. Aa you pointed out in the meeting, our Preliminary Plac for chis project vas approved by the City of Coppell Council in its formal session on June 10, 1986. Tha preliminary plac is good for nine months if a final plac is not submitted. Therefore our preliminary plat would expire March 10, 1987. Due to reasons which I viii explain, ic is nsc anticipated chac the final plat for chis project will be submitted prior to the expiration dace. With chis letter, we are hereby requesting an extension on the Preliminary PlaC approval for an additional nine months. Attached are the Preliminary PlaC review commence from the City of Coppell and the review comments of Ginn Inc. Consulting Engineers. There are ~wo primary obstacles confronting us which have delayed the submittal of a Final Plat. The first.issue is an agreement between the City of Coppell and City of Grapevine. This agreement was requested by the City Engineers of both cities in our preliminary meetings. Mr, Powell (Coppell) and Mr. Baddaker (Grapevine) agreed, prior co approval of the Preliminary Plat, chac the City Attorney for Grapevine would prepare a draft of the agreement and deliver it to Mr. Powell for review and co~enc. We volunteered on numerous occasions co help with the preparation of the agreement in any way possible. We had been told the draft was completed, buc until our meeting Monday had nsc seen ~he actual document. I believe ic is apparent thac delays resulting from preparacion of the asreemenC between the Cities of Coppell and Grapevine vas beyond the control of G.A.I. or the property owners. The second issue pertains to sanitary sewar service Co the proparcy. We have been informed chac the City of Coppell requires complete approval of engineering plans prior to Final Plac approval. We have also been cold thac chis site will have co be annexed by the Coppell Municipal Utility District ,Ms. Taryon Bowman January 15, 1987 Second Page No. ! (H.U.D.) prior to final plat approval. Graham Associates, Inc. has attended several H.U.D. board meetings and has requested annexation. The board does not have a preestablished method for determining annexation fees. The latest recommendation for a fee assessment could put a tremendous financial burden on this development. It appeared the board was hesitant to move quickly on any annexation action with the pending take over of the district by the City of Coppell. We have serious concerns about the inequity of the suggested fees and the data used to determine the fees. Due to the above issues, final platting is not possible at this time. However, the property owner would like to proceed with the channel£zation and grading of the site. By accomplishing this construction, we feel the marketability of the property would be enhanced. Ail design approvals are in order for the channel construction, and ye are prepared to begin work once the easement, in the City of Coppell portion, is approved for filing with Dallas County.
