RE: 322 Hearthstone / Lot 14, Block 1 Old Coppell Estates
This letter is written in response to my telephone conversation of July 13, 2000 with Mr. Garvin
HasselI, the owner of the property at 322 Hearthstone. When Old Coppell Estates was platted, a
sanitary sewer easement was platted along the side of 322 Hearthstone and a sanitary sewer line
was constructed within the easement. There was also an existing sewer easement and sewer line
at the rear of the property. Based on my conversation with Mr. Hassell, it appears that his
swimming pool has been constructed within the sanitary sewer easement and over the sanitary
sewer line. Because of the location of the pool, the City will be forced to perform future repairs
to the sewer line without excavating the sewer line. This is accomplished by the installation of
some type of liner placed in the sewer line. Again, it is highly unlikely that the City' would
attempt to excavate the sewer line beneath the swimming pool.
It should be noted that the pool over the sewer line could experience future problems if the sewer
line were to develop a separation beneath the pool. A separation could cause soil to be drawn
into the sewer line creating voids beneath the pool. This in turn could have an affect on the
cosmetic or structural integrity of the pool or the piping beneath the pool. The City has a
program in place to televise and clean sewer lines so hopefully any future separation of the sewer
line would be discovered before it became a major problem. However, no guarantees can be
offered.
Because the sanitary sewer easement has a sewer line in it, the City cannot abandon the
sewer easement.
