Assistant City Manager 255 Parkway Blvd. Coppell, TX 75019 Re: Gas Street Lights; Old Coppell Estates Dear Mr. 'Griffin: As we discussed this morning, Lone Star Gas Company ("Lone Star") is providing this letter to the City of Coppell as confirmation of the commitment of Lone Star concerning maintenance and billing for the gas street lights that are to be installed in the Old Coppell Estates Subdivision ("Subdivision"). These gas street lights will be installed in the Subdivision by Lone Star pursuant to an agreement between the developer, WPC-Bethel Development Corporation, and Lone Star. Lone Star will maintain and repair the ten gas street lights to be installed in the Subdivision. This maintenance and repair service will include mantle, pane, and burner replacement, as well as relighting service, as needed. Lone Star would also be responsible for the replacement of the gas lights in the event of damage. Lone Star will be entitled to recover the cost of maintenance, repair and replacement of the gas street lights through its rates for such gas street light service, as such rates may exist from time to time. To assist in the provision of maintenance, repair and replacement of the gas street lights, Lone Star will maintain a twenty-four hour emergency telephone service number (1-800-817-8090). You can also call 214-219-0951 between the hours ofg:00 a.m. to 5:00 p.m. to request maintenance, repair or replacements. The City of Coppell shall be responsible for the payment of bills for the gas street light service. Pending the establishment of a separate municipal gas street light rate, the commercial rate for gas service in the City of Coppell will be used in calculating the bills for this service. In lieu of metered consumption for this service, Lone Star will base the bills for this service on an assumed consumption of 3.25 Mcfper month per light. The City of Coppell will pay in advance a sum of $4,006.00, which is based on the assumed consumption of the ten gas street lights for a two year period times the commercial rate for gas service in the City of Coppell for the month of January, 1996, including the purchased gas cost adjustment applicable for that month. At, er the first two years of consumption, January 11, 1996 City of Coppeil Page 2 Lone Star will bill the City of Coppell on a monthly basis for this service, and the City will pay such bills in a timely manner.
