1. Issues regarding screening at the Malzahn property line were discussed at the City
Council zoning hearing. The Council concurred that no screening would be required in

~ ..be incorporated into the adjoining lots per the Council-approved PD site plan. Areas in
those side yards directly abutting Thweat will be landscaped with trees and plant mate-
rial of the size, type, and quantity called for along major city streets in the streetscape
ordinance.
The final plat shall have a note stating that certain improvements may be prohibited by
the City of Coppell Floodplain Ordinance within the floodplain areas of Lots 13-32.
The area of impact (that is far less than one acre) falls under the nationwide Corps of
Engineers 404 permit. Under this federal law, there is no requirement for environmental
mitigation due to the filling of jurisdictional waters of the United States. The Oak Bend
residential PD, however, is designed to preclude channelization along Cottonwood
Creek or reclamation as could be submitted within City of Coppell floodplain ordinance
reclamation standards and guidelines. Major stands of vegetation, wetlands, and natu-
ral stream conditions will therefore remain essentially unaltered. ~.is preservation
approach will yield over 'nine (9) acres of open space and creek area that will provide
ample wildlife habitat of excellent quality.

1. The Planning and Zoning Coordinator and Building Official shall determine requirements
for screening walls along Freeport Parkway proposed and at property line with Malzahn.
2. A homeowners maintenance agreement, bylaws of a homeowners association are needed
to maintain all common areas and image zone landscape along Thweatt, and conceptual
landscape plan are needed with this submittal and are missing.
$. As a part of the covenants, codes and restrictions for those homes in Block A Lots
13 through 32 should include the prohibition of improvements within the floodplain.
4. Block C Lot 2 - What mitigating factors are to be used in filling the pond i.e.
displacement of wildlife in pond.
