Per your request, copies of the soils testing reports (being prepared by Maxim Engineers) will be forwarded to both you and Dale Jackson. We have spoken with Dale Jackson and he has expressed concurrence with the start of early grading. Full testing of placed fills will be undertaken during the excavation operation. Attached herewith is a letter from Nathan D. Maier Engineers stating that no grading activity will be taking place in the flood plain during this project. No reclamation activities are planned for the stream area, as it will remain in its natural state. Centex Real Estate Corporation accepts responsibility for damage to public utilities or adjacent property as a direct result of the grading activities taking place. The fill for the creek lots begin at the ultimate 100-year floodplain line. This line, as you know is more conservative than the FEMA line.
