July 27, 1990 Ms. Shohre Daneshmand City of Coppell 255 Parkway Blvd. Coppell, Texas 75019 Re: Oakbend Addition NDM No.: 8g-g-lO6 Dear Shohre: Enclosed are the cross sections you requested from Mr. Derek Earle showing the topography on the west side of the Cistercian Tract. As you can see, there is ample grade to allow for runoff. Let me review our options for the handling of this storm water. QDtion One - Collect the water in the alley and take it out of its watershed in an underground system through the Oakbend project. This option is unacceptable to my client for two reasons. First, if we cut off entirely the fiow of water to our downstream neighbor, we may be breaking the laws of the State. Secondly, we have the legal fight, in addition to the legal obligation, to continue to observe historical drainage patterns. Having already been forced into spending a great deal of money to reroute most of the water that should have been drained to the Cistercian tract, we feel we have already gone the extra mile in this matter. ~;~ -- Collect the water in the alley and discharge it into the existing ditch. This will requite the condemnation of an easement by the City. if the City wants to pursue this, we will be cooperative. All we ask is that, if this is the City's preferred option, it is pursued immi- nently and aggressively. ~ -- Allow the drainage to sheet flow onto the Cistercian prol~rty. This is my client's favored approach, quite simply because it is what the Cistercians have insisted upon as the only solution that will not result in a lawsuit. Although it is our belief that this is a suit that they could not win, we have little doubt that they would indeed file it. The idea of defending ourselves in court is not appealing to us, and I am sure that the City feels the same way. Obviously, when the Cistercian property develops, this drainage will have to be dealt wlth In a sound engineering manner. They have cleady and forcefully described their preference as to how the water is delivered to them. We have reluctantly accepted their demands. We understand that the staff's major concern is that, if the Cistercian tract is rezoned at some future date to a single-family use, water would be sheet flowing onto the rear of lots, potentially causing drainage problems similar to the Kaye Street situation. We would offer two thoughts for your considera- tion. First, the root problem at Kaye Street is that the ground is virtually fiat. Luckily, this is not a prob- lem here. The relatively steep grade should allow any water coming onto these lots to be taken easily Three NorthPark/8800 N. Secondly, it is always possible, at some future date, to install a curb and inlet on the east side of the alley to create a concentrated situation, if this becomes desirable.
