Re: Univest - Park Place Addition
Dear Steve:
Reference is made to the April 27 letter from Mike Allen
regarding the above referenced project.
We have no objections to his requests for confirmation of the
three items listed on page 2 of the letter.
Steve, we believe that the whole issue of the linear park/mutual
drainage easement should be reconsidered at this time. From an
overview, it appears that some of the following could possibly
happen.
1. ABQ could sell off parcels, exclusive of the drainage
easement, thus, there would be no requirement from the
adjacent developer to improve the easement or develop the
linear park.
2. The cost of developing the linear park is too much to attach
to any singular, smaller project, thus, the total cost must
be pro rated to the entire ABQ development if it is to
occur.
3. ABQ could sell off the mutual drainage easement to a
separate corporation with no assets, thus, if citations were
issued in the future for maintenance, there could be
problems with the City collecting these citations.
4. The drainage easement/linear park is becoming a nuisance
with no maintenance by the City or private ownership.
Future maintenance by the City is excluded because it is
private property.
5. Legal problems could arise between adjacent landowners with
the City involved regarding stormwater flows for ultimate
development.

6. The future land uses adjacent to the drainage easement may
not warrant a linear park.
These are some of the items that we think need to be thoroughly
reconsidered at this time and develop a program on how the City
wishes to address the development of the linear park/drainage
easement.
