MJ Design Roadway Impact Fees
On June 5, 1996 a letter was mailed to Michad E. Nuzum, with Dupey Management Corp.,
(MJ Design) assigning Roadway Impact Fee credits of $250,000 to the easternmost 51.3722
acres of the approximately 67 acres of real property comprising Lot 2, Block 2 of the replat
of Block 1 and 2, Parkwest Commerce Center. The letter stated that the credits could be
used for the 51.3722 acres, allowing a 75% reduction of Roadway Impact fees assessed for
any development on the property.
Thi.~ past year MJ Design sold 16.206 acres of the undeveloped portion of their lot. The
portion of the lot they sold was not included in the original 51.3722 acres, which were given
an Impact Fee credit of $250,000. In reading the June 5~ letter, the second paragraph
stated that at the time of any specific development on the remaining property the possibility
of obtaining similar Impact Fee credits would be considered.
Since the proposed development is similar to the other developments i.e., warehouse use,
please consider this property for a 75% reduction toward the Roadway Impact Fee.

Re: Roadway Facilities Impact Fee Credit
Dear Mike:
Thc City has completed our assessment of our existing Resolutions and Ordinances relating to Roadway
Impact Fees. Based on this assessment, we are hereby assigning Roadway Impact Fee credits of
$250,000 (the "Credits") to the easternmost 51.3722 acres of the approximately 67 acres of real
property comprising Lot 2, Block 2 of the Replat of Block 1 and 2, Park West Commerce Center
Addition to the City of Coppell, Dallas County, Texas (which 67-acre tract was recenQy sold by Dupey
Management Corporation to the Northwestern Mutual Life Insurance Company). These credits may
be utili?~! for that 51-acre tract at the time that a building permit is applied for. It is at that point that
the City will make an assessment for the Roadway Impact Fees, and the Credits can be utili~red by the
developer of that 51-acre tract in offsetting up to 75 % of the impact fees due at the development stage.
If the development of the 5 l-acre tract occurs in stages, the Credits may be used a porQon at a time
although the portion of the Credits to be used in connection with any particular development stage may
not in any event exceed 75 % of the impact fees due at that stage.
Furthermore, it is my understanding that your company has retained certain reacquisition rights to
approximately 16 acres of the 67-acre tract described above (such 16-acre tract representing the
westernmost portion of the 67-acre trac0. At the time that any specific development is planned for the
16-acre tract, you may feel free to contact me about the possibility of obtaining similar impact fee
credits for the 16-acre tract, although the amount of such credits, if any, would naturally depend in part
on the nature of the intended development, the amount of the anticipated impact fees, and City
ordinances and policies in effect at that time.
