As you know, on December 11, 1990, we met with your staff to discuss the items and reach a consensus on them. This letter is to confirm the results of that meeting. The primary issues discussed were derived from comments raised during the review of the construction drawings for the 328-acre site. These items are as follows: Comment: "Replace an existing 8" water line along Belt Line Road from Wrangler Drive to Southwestern Drive with a 12" water line." Response: Our construction plans show a 12" water line to be located in Executive Drive which parallels Belt Line Road. According to Howard Pafford, our proposed line sufficiently replaces the need for a larger line in Belt Line Road. ® Comment: "Replace the 8" water line along Southwestern Drive with a 12" water line." Response: Once again, Mr. Pafford represented that replacing the old line with a new 8" water line would be sufficient. AKIN, GUMP, STRAUSS, HAUER & FELD Mr. Steve Goram December 13, 1990 Page 2 Comment: "Replace the 12" sanitary sewer line along Belt Line Road from Airline Drive to Southwestern Drive with a 24" sanitary sewer line." Response: This improvement is included in the City's Capital Improvements Plan and scheduled to be constructed in 1992. According to staff, this line could be built prior to that date by a developer if there is a need. Alternatively, the line would be built by the City as part of the CIP and funded by impact fees which would be levied as users tap into the system. We anticipate that this line will not be necessary for the Park West development within the next few years. Therefore, Prentiss will not be required to construct this line and, it is our understanding, that the line will be constructed by the City and that users will be charged an impact fee in accordance with the impact fee ordinance. ® Se Comment: "Remove the 10" sanitary sewer line on the north side of Airline Drive from International Drive to Belt Line Road and replace it with a 12" line." Response: According to our construction plans, a portion of the load originally intended for this line has been routed to a new sanitary sewer to be located in Wrangler Drive. It is our understanding that staff agrees that this alternative precludes the necessity for a larger line in Airline Drive. Comment: "Wrangler Drive needs to be paved." Response: This street is to be paved as the development progresses in accordance with the phasing program which was approved as part of the final plat. One issue which was not resolved concerned a proposed box culvert in Southwestern Annex. According to our engineers, this improvement is to specifically benefit the owner of property west of Freeport Parkway and is not an obligation of Prentiss Properties. It is our understanding that the improvement shown on the plans to address total build-out on the property across Freeport Parkway. At this time we are attempting to contact that property owner and schedule a meeting to discuss the improvement. Of course, we will keep you apprised of the discussions. Allow me to once again emphasize our position on the box culvert: this improvement is for the benefit of an off-site property owner and not required because of Prentiss Properties development; therefore, the improvement is not an obligation of Prentiss Properties.
