"St~bstnntial improvement" means any repair, reconstruction, or imornvement
of 8 structure, the east of which eQ~mls ~r exceeds 5~ percent of the market value
of the str~eture either:
l) Before the improvement or repair is started, or
2) If the str~tett~re has he~n d~m~ed and i~ heine re,tared, before the d~ma~e
occurred.

jurisdiction of the City.

SEC~ON 3.3 PENAI,TI~ FOR NONCOMPL]ANCE.
No structure or land s~!1 hereafter be eonstrneted, located, extended, eonverte~
or altered without full ~ompli~nce with the terms of this ordinnnco, nnd other applicable
repletions. Violation of the ~ovisions of this ~dinanee by fail.re to ~mulF with
any of its re~uiremen~ (ineludinE violatiom of eonditio~q and safeEuee~ established
in ~nneetion with conditions) shah eonstit.te a misdemeanor. Any ~rson w~ violnt~
this ordinance or fails to comply with any of its reqnirem~nts shall upon conviction
thereof he fined not more t~n Two Hundred ~ollars (S200.00) rot each vlolation.
Nothin~ herein contained shall prevent the City from taking sneh other lay,fa1 action
es is necessary to prevent ~ remedy Ray viol~tion.
SECTION 3.4 ABROGATION AND GREATER RF~qTllICTIONS.
This ordinance is not intended to repeal, abrol,,ete, or impair any exist;oF.
easement~, covenants or deed restrictions, ltowever, where this ordinance and other
ordinance, eaRement~ covennnt or deed restriction ennfliet or over. lap, whichever imposes
the more stripgent restrictions shall prevail.
SECTION 3.5 INTEI1PRETAT]ON.
la the interpretation and application of this ordinance, all provisions shall be:

SECTION 4.1 F~TABLISI:MENT OF DEVELOPMENT PERfalT.

for a Development Permit shall be made on forms furnished by the Local Administrator,
and may include, but not be limited to: plans in duplicate drawn to sealo showing'
the nature~ location, dimensions and elevations of the area in q,~estion; existinR' or
proposed structures, fill, storage of materials, drainage facilities; and the location of
the f oreR'oinl~.
