AT THE CITY COUNCIL MEETING LAST NIGHT - THE PARK WEST COMMERCE CENTER FINAL
PLAT WAS APPROVED. ONE OF THE CONDITIONS OF APPROVAL WAS THAT A WAIVER
REQUIRING SIDEWALKS WAS GRANTED WITH CERTAIN STIPULATIONS. INCLUDED AS A COPY
OF THE PLAT CONDITIONS THAT WERE MADE A PART OF THIS APPROVAL.
NOTE THAT [ HAVE CIRCLED THE SIDEWALK CONDITION.
STEVE - I AM SENDING THIS LETTER DIRECTLY TO YOU BECAUSE IT IS AN UNUSUAL
REQUEST THAT I AM MAKING AND I AM NOT SURE OF THE PROPER CHANNELS.
THIS LETTER IS TO REQUEST THAT THE SIDEWALK NOT BE BUILT AT OUR SITE I
CONSTRUCTION. INCLUDED IS A COPY OF OUR REVISED DRAWING OF THE SITE DIMENSION
PLAN WITH THE WALK REMOVED. WE NEED YOUR PROMPT ACTION SO THAT LARRY DAVIS CAN
MAKE THE FINAL INSPECTION AND GIVE HIS APPROVAL.
PLEASE CALL ME IF THERE IS ANYWAY I CAN HELP EXPEDITE THIS MATTER. I WILL COME
RIGHT OVER FOR A CONFERENCE ANY TIME YOU SAY.

: 1. Final construction plans and profiles for sewer, water and
storm sewers, shall Me submitted and approved by July 10,
1990.
2. Covenants and restrictions shall be executed by the owners b~
May 10~ 1990.
3. The development shall comply with the Floodplain Management
Ordinance. Hydraulic studies muse be submitted and approved
by July 10, 1990.
The 12" sanitary sewer out-fall is almos~ at capacity and the
installation of additional piping (capacitM) will be
required. The developer ma2 be required to participate in
the costs of such improvement in accordance with city
ordinances.
5. A minimum of 20 £oo= utility easements are required except 10
foot easements may be provided a~ locations to Ms approved by
staff.
6. A n~te shall be placed on the final plat stating that
"all applicable development fees must be paid as each ~
develops "
7. P~SINO:
a. Con~tr,,c~on ~lana: Construction plans for the
infrastructure of the entire 328 acre development will
be provided within ninety (90) days of approval of ~he
final plat by ¢it~ Council. Providing drawings for ~he
entire developmen~ assures the City that the
infrastructure will be constructed in accordance wi~ a
master pla~. Any significant deviations from the master
plan will require complete review of the entire ~28 acre
development.
b. Construction off ln.*r,str,,ct~re: Utilities al~d roadways
will be constructed when needed to support development
of ~ny new lot. Construction permits must be obtained
from the P~blic Works Department for such infrastructure
improvements a~d a letter of final acceptance of
infrastructure ~s rec/uired before a bulldia~ permit can
be issued. However, if in the opinion of-the Director
of Public Works it is warranted, the Director may
recommend ~o the Building Inspec~ion Departmen~ tha~ a
temporar~ building permi= be issued wi~h the
understanding that the fine! letter of acceptance
be procurred within a reasonable time. Prior to
construction, the builder must obtain a building permit.
Be£ore a structure is occupied, a certl£icate of
occupancy must be obtained. Any requirements for
infrastructure or bulldinq development in e£fect a~ the
time of construction must be followed unless otherwise
addressed in these conditions. During the replactinq
phase, the in£rastructure needs will be assessed.
Obtaining a building permit will trigger ~he
construction of any additional in£ras~ructure necessary.
Finally, the additional infraetruc~ure needed for the
construction o~ buildings on any replanted lot will need
to be £ully installed prior to the issuance of a
certificate of occupancy for that lo~.
c. Construction Permit Feeq: The City currently requires
~hat ~00~ o£ the of the filing fee for the ~inal plat be
escrowed prior to approval of the final plat (the
"inspectio~ fee"). Additionally, the Subdivision
Ordinance requires 2he Developer to escrow an amount
equal to 1.5~ off the cos2 of items to be constructed ~or
dedication to the city (~he "Construction Permit Fee").
A variance to Section XVI, Paragraph E o£ the
Subdivision Ordinance is hereby granted to allow the
Developer to (i) pay inspection fees prior to the
approval of £inal replats in amounts equal to 100~ of
the ~iling £ee for each respective replat~ and (ii) pay
the construction permi~ fees prior to obtaining
construction permits £or improvements necessary for each
replay i~ amounts equal 2o ~.5~ of ~he i~em~ to be
constructed ~or dedication to the City ~e~essary for
each respective replaY.
d. ~o~thwes~ern Dr4ve~ Southwestern Drive shall be
constructed as a four lane divided thoroughfare.
Construction of Southwestern Drive shall be
until such time that traffic on Southwestern Drive
exceeds 8000 trips per day or as determined by ~he City
Engineer.
SI~EWAr.K~: Sidewalks shall be provided along Belt Line Road~
in accordance with the City Subdivision Ordinance. Sidewalks
~or 2he remainder of the development will be installed by the
property owners' association when deemed necessary b~ a
majority.of property owners, cr 2he City. The covenants and/
res~rict~one shall be amended accordingly to require the
property owners' association to construct the sidewalks what/
so advised.
