NB 3uly Z3, 1986 The Honorable tou Duggan City Council City of Coppell 616 South Coppell Street Coppell, Texas 75019 RE: DeForest Road Improvements Gentlemen: Pursuant to action taken by the Coppell City Council on 3uly 7, 1986, Triland Investment Group hereby agrees to make the following Improvements to existing DeForest Road: 1) Provide a 2" asphalt overlay from MacArthur Boulevard east to the terminus of DeForest, following the existing profile grades; and Clear the existing ditch on the north side of the road in order to improve local storm drainage. This work will be performed by Triland~ at our sole expense sub3ect only to the City (a) allowing Triland and its contractors to perform the work, through the issuance of appropriate permits and (b) indemnifying Trtland from any potential claims from ad3acent property owners regarding the performance of the work. In a related matter~ it is understood that funds tn the amount of $327,500 are required to be escrowed for future improvements to DeForest Road. Triland Investment Group recognizes that this assessment is reasonable and consistent with obligations to which have already been agreed. As we have previously stated~ these costs are assessable to the existing property owners on the south side of DeForest, specifically Auburn Homes and Dimension/Brooks Corp. This obligation was included in the respective sale to each of these groups~ and it is our understanding that each stands ready to cooperate with the City on this matter. However, it is my understanding that~ during the above mentioned council meeting~ the assessment was determined by taking one-half of the estimated cost of the roadway. State law permits assessment at only .90 of the total cost. Therefore~ the assessment would be .45 to the southern property owners.
