REOUEST: Zoning Change from 2F-9 to a Planned Development for SF-!2 and S¥-9. APPLICANT: Mr. David Phillips 453 Hidden Valley Drive Coppeil, Texas 75019 HISTORY: A preliminary and final plat with variances was approved by the City Council on January 8, 1985. Mr. Phillips requested three (3) variances: 1) no dedicated streets; 2) no alleys; 3) no street lights; and they were approved with the stipulation that the applicant be agreeable to a City initiated zoning change on the property from 2F-9 to SF-12. This case (ZC-511) was brought to City staff's attention that this item had not been taken care of, as stated in the January 8, 1985 C~tv Council minutes, and staff has been working on this case for the past year to resolve this matter. The City Council remanded the case back to staff to look at some type of PD-zoning classification, and to address variance requests made by Mr. Phillips. STAFF RECOMMENDATION: Several variances are being requested by the developer. They are as follow~: VARIANCE #I: Request for no alley. STAFF CO.~iMENT: There are presently no alleys in the surrounding neighborhood. Trash pick-up and utilities must be located in the front of lots. VARIANCE #2: No sidewalks. STAFF COMmeNT: Sidewalks are required as per the Subdivision Ordinance, and the surrounding properties do not have sidewalks; however, sidewalks serve the purpose of supporting foot traffic, thereby offering safety for pedestrians. VARIANCE #3, #4, #5, #6: Water mains and sewer mains be accepted. STAFF COMMENT: Please see attached staff comments from Ginn, Inc. and the Public Works Department. VARIANCE #5: That the City agree to release and abandon any/all easements on the property if and when a sewer line must be relocated at mo expense to the owner. STAFF COM~ENT: This issue is not appropriate to be addressed during zoning, and should be addressed during the platting stage. VARIANCE #6: 24' wide cro~med streets with surface drainage along each side. STAFF COM}i. ENT: Please see attached comments from Ginn, Inc. and the Public Works Department. VARIANCE #7: Request that water and sewer impact fees be waived. STAFF COM~NT: Staff will address this item during the meeting. ANALYSIS: The variances requested by the Developer are all issues that are normally addressed during platting procedures. If this PD is approved as a concept plan, the Zoning Ordinance regulations require that prior to any construction on the property, a detailed site plan must be submitted and approved by the City Council. This means that more detailed information must be submitted prior to the issuance of a building permit, and that this plan will be approved in concept only. Therefore, staff recommends that the variances be deferred until either a detailed site plan or preliminary plat have been submitted. No water impact fees or sewer impact fees will be charged on this property since pro-rata to cover these was pal9 in 1982. i believe this planned development will be compatible with the surrounding development and dispel any fears of how the property might be used in the future. However, if this is acceptable for Council review, staff submits the following: Variance 1 & 2 - No comments (better addressed by Building Inspections) Variance 3 - The Subdivision Ordinance/ Standard Construction Details require alleys, sidewalks and drainage systems in new developments. The area contiguous to this property does not have sidewalks, alleys or underground storm sewers. If this variance is approved by Council, it would be Public Work's recommendation that it not be allowed for the construction of inverted driveways with sufficient culverts being installed during the building phase. Also, once the infrastructure should be installed prior to b~ilding permits being issued, every area within the drainage way be completed sodded, and that this exist throughout the construction of homes in the area. Variance 4 - The area to the east and south of this development does not have curbs and presently is facilitated by 6" water and ~sanitary sewer. The utilities will be connecting to a 6" line and as long as the Fire Department is satisfied with the fire flow capability, staff has no objection to 6" It is felt, however, that curb and gutter is necessary. Variance 5 - Staff feels this will be at Council's descretion. Variance 6 - Staff is unclear to the request of this variance and needs further information before recommendation can be formulated. In general, variances number 2 and 3 requested, waive most of the requirements of the sub-division ordinance. We are not in favor of these requested variances since they produce a sub-standard sub-division. Appearance, maintenance and fire protection are some of the reasons our standards are what they are in the City's sub-division ordinance. Plat Application #84-C5-22.1 - to consider approval of a preliminary plat of Northlake Woodlands East, Phase VI on the property located on the northeast corner of Beltline Road and Moore Road Mr. Steve Parsons made the presentation to the Council. He stated that the Planning and Zoning Commission has recommended approval of this plat . An item of concern was expressed 12y the Council concerning the 15-foot variance for the building line along Moore Road. Following discussion, Mayor Pro Tern Thompson moved that this plat be approved with the knowledge that all items of concern will be addressed prior to the final plat presentation; Councilman Pert;john seconded and motion carried 5-0. 7. Plat Application #84-09-28 - to consider approval of a prelilminary plat of Independent Community Subdivision (Coppel Bank) on property located on the Southeast corner of the intersection of Denton Tap Road and Braewood Drive Mr. Jack Gist of Kirk, Voich and Gist, Engineers, made the presentation to the Council. During discussion of this project, Council expressed the preference that electrical connections to the property be underground, that a six foot screening wall be placed along the east property line, and that masonry and some type of greenery be included along all screening walls as well as a water system for the landscaping. Entryway signs will be included as well as brick pavers. An additional area of concern to be addressed before final plat presentation is the drainage along Denton Tap Road . Mayor Brown then commended the developer on his continuit.v of design of this development with those to the north. Following further discussion, Councilman Duggan moved that this plat be approved with the stipulation that all problems and areas of concern be resolved before final plat presentation; Councilman Bailey seconded and motion carried 4-C:-1 with Ccuncilman Ware abstaining. 8. Plat Application #84-09-18 - to consider approval of preliminary plat of Phillips Addition 111 on the property located 1100 feet East of Denton Tap and 600 feet South of Bethel School Road behind the First Baptist Church Mr. David Phillips made the presentation to the Council. He stated that he is requesting three variances. They are 1) no dedicated street, 2) no alley, and 3) no street lights. Mr. Phillips noted that at the time his subdivision was originally developed, that a private drive was allowed and that it was in compliance with all ordinances of the City. He also stated that he will not be coming back before the Council for another request on this subdivision unless the plat includes a street dedication. He was informed that the City will initiate the zoning change for this property. Following discusssion, Councilman Pert;john moved that the final plat be approved subject to the conditions in the previous motion; Councilman Ware seconded and motion carried 3-2 with Mayor Pro Tern Thompson and Councilman Duggan ff voting against the motion. 10. Plat Application #84-10-18.1 - to consider approval of final plat of Highland Meadow on the property located south of the intersection of Sandy Lake Road and Lodge Road Mr. Mike Allen of Un;vest Corporation made the presentation to the Council. Commissioner Weaver seconded the motion; motion carried (6-0) with Chairman Munsch and Commissioners Green, Johnson, Thomas, Tunnell and Weaver voting in favor of the motion. PUBLIC HEARIgGS Item 5: To consider amending the Comprehensive Zoning Ordinance, Section 29.15(3)A and (3)(F), to provide that a private club shall not be located closer than 300 feet of any residential structure and defining residential structure. P&Z Coordinator Taryon Bowman made the introduction to the Commission. Chairman Munsch then opened the public hearing and asked for persons wishing to speak in opposition to the request. There were none. He then asked for persons wishing to speak in favor of the request. Again there were none. The public hearing was then closed. Following discussion, Commissioner Tunnell moved to deny the amendment to the Comprehensive Zoning Ordinance. Commissioner Johnson seconded the motion; motion carried (5-1) with Chairman Munsch and Commissioners Green, Johnson, Thomas and Tunnell voting in favor of the motion, and Commissioner Weaver voting against the motion. Item 6: To consider approval of a zoning change, Case ~PD-106, from (2F-9) to a Planned Development for (SF-12) and (SF-9), Minutes of August 18, 1988 Plznning & Zoning Commission Page 2 located east of Denton Tap Road and south of Hidden Valley Drive, at the request of Mr. David Phillips. Item 7: To consider approval of a zoning change, Case #ZC-515, from (A) Agricultural to (LI) Light Industrial to allow the devel- opment of an industrial park, located approximately 1,600 feet east of Denton Tap Road, south of the St. Louis and Southwest- ern Railroad and fronting along Beltline Road, at the request of Northlake Beltline Limited Partnership. Taryon Bowman again introduced the item to the Commission. Nathan Maier of Nathan Maier Engineering, was present to make the presentation to the Commission. Mr. Maier stated that he is representing the property owner, Mr. Thompson. Mr. Peter Staks of Nathan Maier Engineering was also present.
