As a par~ of ~hat agreemem=, you are ~o crea~e a new homeo~ers association for =he homeo~ers wes~ of Mac~hur and we agreed to rele~s~ ~hose homeo~ers from our associa=lon when ~hey loin your eseocia~lon. It was our goal ~o have ~his completed by the end of T~e seems ~o be slipping away and I ~ concerned ~hat the ho~o~ers in Not,blake Woodlamds Hills may become energized again. E~ually ~or~an=, I feel as =hough we have an obliga~ion ~o ~he ho~o~ers and =he Co~p~11 City Council =o follow through on our c~i=menC. To ~ha~ end, I ~ again offering our se~ices a~d coo~ration to assist you in ~hls regard. The following is an outline of a suggested course of action~ 1. You could use ~he c~ren~ Riverchase ~ers ~socia~lon recorded Declaration as a ~o~at for ~ur o~ers associa=lon. You s~ould, of course, ~ke any changes which migh= be applicable ~o your area, ~lus any o=her items ~u mkght wash change. For ex~ple, I ~ow you have ve~ specific ideas abou~ ~chl~ec=ural con~rols. In any even~, ~ur la,er could use =his fo~a~ for crea=ing a doc~en= ve~ quickly and economically. 2. When ~ur new homeo~ers association doc~en~ is ready for filing, we would conu~raneously make a filing in uhe deed records in which (i) your homeo~ers associa=lon Is created, ~d (ii) our associa=ion Is ~ended ~o release =hose homeo~ers ~s= of Mac~=hur who have chosen ~o ]o~n your association. In this ~nner, no homeo~er can escape ~ing a me,er of one of ~he u~ associa=ions. You should consult with your lawyer, but it occurs to me that the vehicle for your homeowners choosing to Join your new association would be tho execution of a document (l) recognizing the new association, and (ii) agreeing that their property will become subject to the new homeowner assoc~ation rules. This could be accomplishedbyhavingyour law, er draft a document providing Just that. It could be a short form document w~th blanks to be filled in wiuh =he names of each property owner (exactly as it stands in the deed records)~ pro~r=y descr£p=lont and an acknowledgement. 4. We discussed the best method for energizing your homeowners to get this accomplished as quickly as ~ossible.
