Ratliff, City Manager FROM: Dale Jackson, Building Official~ RE: Certificate of Occupancy for Golf Course Clubhouse On October 13 a building final inspection was made at the golf course clubhouse at 700 Riverchase Drive. The inspection revealed several items that were incomplete. One of the incomplete items was the installation of the landscaping at the site. Section 33.3 1. of the Zoning Ordinance requires all common area landscaping to be installed prior to the issuance of a certificate of occupancy for any use other than an agricultural use. The section goes on to allow the property owner the option to issue a letter of credit to the city or to escrow money into an account controlled by the city that would be of an amount equal to 110% of the cost of the landscape work that was incomplete. Section 307 (d) of the Uniform Building Code allows the Building Official to issue a temporary certificate of occupancy for a building prior to the completion of the building provided that no substantial hazard will result from the occupancy of the building. However, section 33.3 1. of the Zoning Ordinance specifically states that no certificate of occupancy can be issued until all landscape work has been completed. Since the items that were not completed did not constitute a potential hazard to the occupants of the structure, I agreed to issue a temporary certificate of occupancy to American Golf provided that the landscape issue was resolved. The issue was further complicated by the fact that American Golf had advertised a VIP party for the weekend of October 15 and 16. American Golf planned to utilize the golf course and the clubhouse facility, at the party event, for the convenience of the guests. I was not contacted by American Golf prior to 5:00 p.m. on the day prior to the scheduled party; therefore, I decided to visit the clubhouse on Saturday to ascertain whether the clubhouse was occupied without the issuance of a certificate of occupancy. When I visited the site on Saturday, I observed that the clubhouse was open to the guests that were invited by American C~lf. I also visited the site on Sunday, October 16 and observed that the clubhouse was again open to the guests of American Golf. Alan D. Ratliff October 19, 1988 Page 2 Since American Golf knowingly violated the requirements of the Zoning Ordinance, I am in the process of issuing a citation to American Golf for each day the clubhouse was occupied. Today, Ken James informed me that a cashier's check was being sent via Federal Express to the city for approximately $31,000.00. The cashier's check will be an acceptable alternative to the letter of credit. I have agreed to allow the clubhouse to open during the morning of October 20 provided that the cashier's check is received before noon of October 20. Once the cashier's check is received, I will issue a temporary certificate of occupancy for the clubhouse.
