RE: Creekview Drive Project ST 00-01
Dear Mr. Bracken:
This letter is written as a follow-up to our telephone conversation concerning the proposal for
materials testing on Creekview Drive. On the itemized list of costs, I expressed a concern about
concrete inspection. Your explanation of this item was that it was placed for your personnel to
obtain the cylinders for testing and to be on the job site during the course of the concrete pours.
The argument you made for this line item did have some merit in insuring a quality product. At
this time, I am not requesting that it be removed from the proposal.
In the actual agreement, I am requesting changes as follows:
1. Under Site Access and Site Conditions, be very specific that if Rone causes any damage then
they would be responsible for correcting that damage. Also, the sentence in the same area
stating that the client waives any claims against Rone should be removed from the agreement.
2. Under Billing and Payment, the sentence discussing the 1 ½-% charge for delinquent payments
should be removed.
3. Under Discovery of Unanticipated Hazardous Materials, the first paragraph relating to the
client's effort to evaluate hazardous materials should be removed.
5. Under Dispute Resolution, it should be clear that any claim would be tried in Dallas County.
Please make the requested changes and resubmit originals for signatures by the City of Coppell.
