HISTORY:
There is no prior platting history on the proposed site. A preliminary
plat for this site and the remainder of the Denton Tap Development,
was approved by City Council on August 12, 1997. However, a final
plat for the subject property was never submitted.
TRANSPORTATION: Denton Tap Road is an improved six-lane divided
thoroughfare (P6D) contained within a 100' -wide right -of -way.

neighborhood retail.

In conjunction with the request for Special Use Permit approval
(S -1193, Grandy's), the applicant is also requesting Minor Plat
approval for a 1.390 -acre portion of unplatted property located at the
northwest corner of Fitness Court and Denton Tap Road. The
proposed plat indicates all fire lane /mutual access easements and
other development related easements.
At the request of the staff, the applicant has provided a note on the
plat indicating the abandonment of an additional sidewalk and utility
easement, which is no longer needed. The abandonment will be
executed by separate instrument. Additionally, the applicant needs
to correct the labels on the plat indicating front -yard setback
requirements. According to Section 12 -23 -3 of the Zoning
Ordinance, the minimum front -yard setback in the C (Commercial)
zoning district, with the provision of front -yard parking, is 60'. The
minimum front -yard setback, without the provision of parking, is
30'.
The applicant has identified the property as Lot 1 R, Block A, Denton
Tap Development; however, the property has not been previously
platted and would not require an R (Revision) designation after the
lot number. The lot number needs to be revised to read only "Lot 1,
Block A, Denton Tap Development."

RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
Staff is recommending DENIAL of the Minor Plat because it is likely that fire lanes
and/or other easements may shift on the site as a result of the applicant making
revisions to the corresponding site plan (Grandy's Special Use Permit- 1193).
