Item 13 SURROUNDING LAND USE & ZONING: North - vacant; Retail South - vacant, and DART r.o.w.; Retail East - vacant; MF-2 West - developing shopping center; Retail COMPREHENSIVE PLAN: The Plan shows retail uses as most appropriate here. ANALYSIS: Although comments have been made in the past regarding the wisdom of placing day care facilities in commercially used areas, the Zoning Ordinance recognizes day care centers as allowable by right in these districts, and staff will not dwell on that issue. In analyzing this site plan, we note the applicant is abiding by all our regulations relative to signage, landscaping, parking, open space required, etc. At one point there was concern that the fire lane configuration would not meet City guidelines. That problem has been resolved and the applicant has agreed to the placement of a statement on the plat document (as well as submitting a letter) that states the fire lane located along the common northern property boundary (between lots D and E) will be constructed when deemed necessary by the City. That being the case, and the fact that the use is allowed in R zoned areas, this proposal can be approved.
