Huffmes 8222 Douglas Ave., Suite 600 Dallas, Texas 75225-5923 RE: Riverview Estates Off-site Grading Dear Mr. Huffines: This letter is a follow-up to the letter sent to you on September 16, 1.999 regarding the grading of property at 1410 and 1430 Sandy Lake Road (letter attached). It is still apparent that grading and fill activities on this property are contributing to drainage problems. These problems directly affect Coppell citizens living in Riverview Estates. As documented in the previous letter, the proper grading of this property is a requirement of the Conditional Letter of Map Revision (CLOMR) approved by FEMA. Based on the grading plans, this includes accepting drainage from the south and conveying it to the drainage ditch located along the south edge of Sandy Lake Road. Recent inspection of the property indicates that, to date, this has not been done. The previous letter was somewhat open-ended in allowing compliance to the City's requirements. Please be aware that improper grading of floodplain violates the requirements of the CLOMR, the City Floodplain Development Permit, and the City's Floodplain Management Ordinance. As such, upon conviction of this violation, the property owner is subject to a fine of $500 per violation. Each day that the violation is not corrected is considered a separate violation. Please provide the information requested in the previous letter as soon as possible to document the topography of the property. The City's goal in this matter is to enforce compliance of the grading plan as approved. Please contact me within two weeks to provide a plan to address this issue. Box 478 Coppell, Texas 75019 972-462-0022 September 16, 1999 Dear Mr. Huffines: The City of Coppell Engineering Department was recently contacted by a resident concerning a drainage problem along the north side of Riverview Estates, directly adjacent to properties owned by you at 1410 and 1430 Sandy Lake Road. Upon inspection of the drainage problem, it is apparent that grading and fill activities on your property are contributing factors. According to the engineering plans for Riverview Estates, your property should be graded such that it will receive and carry drainage from the south to the drainage ditch located along the south side of Sandy Lake Road. Further, the grading plan for this property was submitted to the Federal Emergency Management Agency (FEMA) as part of a report supporting a Conditional Letter of Map Revision (CLOMR) to the FEMA floodplain map (the CLOMR is the document that allowed for filling and grading activities on the property without violating the City of Coppell Floodplain Management Ordinance). Accordingly, this property must be graded to adequately convey drainage and to meet the requirements of the CLOMR and the City of Coppell Floodplain Management Ordinance. Visual inspection of this property indicates that the property has not been graded properly, impedes or prevents the flow of storm water to Sandy Lake Road, and does not meet the requirements of the CLOMR. In an effort to correct the current situation, the City asks you to do the following: Provide to the City a recent topographical survey of the property in question to verify that it is or is not in compliance with the requirements of the CLOMR and the Riverview Estates construction plans. Box 478 Coppell, Texas 75019-4409 If the grading does not match the approved grading plan, modify the grading such that it matches the grading plan submitted as part of the Riverview Estates construction plan. This is the same grading plan submitted to FEMA as part of the CLOMR application. The City requests that these items be completed as soon as possible.
