Dear Mr. Huffmes:
This letter is written in response to your fax requesting that you be placed on the next City
Council meeting to obtain a variance from the Floodplain Ordinance to allow you to obtain early
release building permits for land that has yet to be officially reclaimed from the floodplain. The
next meeting that this could be placed on is the November 11, 1997 City Council meeting. To
be placed on that agenda, certain items will need to take place prior to the October 31, 1997,
which is my deadline for agenda items to be placed on the November 11, 1997 City Council
meeting.
On Friday, October 17, 1997, I walked your project in response to various complaints I had
received from residents living in Eagle Point. I did not walk your project to perform a walk thru
that my inspectors typically do, but only to view the fill that had been placed along the south,
west and east side of your development. Prior to my supporting any request for early permits
and a variance to the Floodplain Ordinance to the City Council, several things need to take place.
1. All dirt that has been placed on property currently owned by Eagle Point residents should be
removed.
2. All dirt placed around tree trunks should be removed even if they are on your property. If
the trees are on your property, obviously the 3 to 4 feet of fill will kill the trees, therefore, a
decision needs to be made to construct tree wells around the trees or to remove the fill from
the trees. I am not suggesting the trees be removed. Please be advised the City has a Tree
Ordinance and to remove the trees will require a permit at this stage.
3. All dirt that has been placed behind the building pads along the south side of the subdivision
should be removed, replaced and compacted. It appears as though the fill has just been
pushed into place and no compaction has taken place. This will create an ongoing settlement
and erosion problem for the future home owners.
4. There needs to be proper sloping of the fill dirt along the east side of the subdivision. The
current fill is an abrupt drop off that is unsuitable for future development. The proper 4:1
slope should be obtained along this section on the east side.
5. When the fill material itself has been removed along the rear of the lots, the large rocks some
in excess of 2 feet in diameter, should be removed as they are not suitable for fill material.
6. Adequate positive drainage should be provided between the Riverview Subdivision and the
Eagle Point Subdivision. The recent rains have caused standing water and yard flooding for
property in Eagle Point. This has not been experienced in the past until this fill was placed
against their fences damming water up in their yards.
The removal and reworking of the dirt should come as no surprise as this information has been
conveyed from my inspector to your contractor for some time now. You are also probably
aware that the home owners have been contacting your engineer on this project for some time
now complaining about the dirt work along the rear of their properties. I have spent numerous
hours with the Eagle Point property owners to let them share their concerns about the way the
fill has been placed along the south side of your subdivision. Please don't mistake this letter for
a letter concerning any deficiencies that might be noted during an official walk thru of your
subdivision. These are only items that need to be corrected prior to my support of any early
permits for this subdivision.
