Ratliff; 25-acre tract of land south of and adjacent to E. Sandy Lake Road; flood plain elevation. Dear Mr. Thompson: The above referenced letter was forwarded to my office for processing. In order to properly do so, please complete the enclosed claim form which will be attached to the above stated letter. Because the letter that was hand delivered to the City did not contain a signature, please be sure and sign where indicated on the claim form. Once the form is completed and signed, you may either mail it to the City at the address indicated or bring it directly to the City Secretary Department. I showed Mr. Morrison a "survey grid" of a 25 acre tract of land I own on Sandy Lake Road in the City of Coppell. Mr. Morrison agreed with me that the property was above the 100 year flood elevation. On May 6, 1983, Mr. Morrison sent a letter to Mr. Andy Brown, Mayor of Coppell at that time. The letter said that he had met with me and that the survey grid I had shown him indicated there was an error in the flood map, and if Coppell agreed with the information that I had presented to him, and wanted to issue a development permit without actually changing the maps, then the City would have to send FEMA a letter requesting a floodway revision without a map change. Mr. Morrison was also concerned if any fill had been placed on the property. At that time no fill had been made. A letter by Mr. Troy P. Glidewell to Mr. Morrison, dated June 14~ !983, stated that there had been no fill on the property for the previous nine years. On July 14, 1983, Mr. Morrison sent a letter stating that the City would have to do two things to correct the apparent floodway error. One was to ask for a floodway revision without an actual map change from the City. The other was to adopt a resolution or amendment to the city ordi- nance. After FEMA received the first request they would respond with a letter which would state their opinion. On July 21, 1983, Mr. Scott Barnett, City of Coppell Staff, sent a letter to Mr. Morrison asking for a floodway revision without an actual map change. The first item having been met, Mr. Morrison sent a letter on August 3, 1983, that FEMA had no objection to the proposed revision on the floodway limits of the 25 acre tract. At that time the City had no objection to my fill and removal of topsoil. I had been working on that property until Russell Doyle said that the City was changing the floodway boundaries. When I gave him copies of the letters from the City and from FEMA, it didn't seem to make any difference. I asked if he could get the City to look at the case and was told that when you buy flood property, that is what you own. I did not buy flood property. I bought property that could be developed with very little cost. I proved that, to the City of Coppell and to FEMA. Now my property has been damaged by the negligence of the City. Since the City of Coppell approved the new flood ordinance, the flood elevation on my property has changed from 443 to 445. My property was not in the flood plain in 1983, but in 1988, it is. If the City of Coppell needs this property for water storage to help the community, then they need to pay 2.5 million dollars for 25 acres of retail property. I do not feel that I should be called upon to donate that much to the City of Coppell. If the City doesn't wish to buy the property that they allowed to be changed in the flood elevation, then there will be a cost of approximately $1,250,000.00 damage, plus engineering and maybe more, if loss of acreage has occurred. O. Box 478 Coppell, Texas 75019 Dear Mayor Brown: Reference is made to our conversation of May 4, 1983, and my visit with Mr. Johnny Thompson of Coppell. Mr. Thompson presented me w'ith a surveyed grid of property located in the regulatory floodway of the city of Coppell, Texas (attached). This grid shows the property to be above the 100 year flood elevation, which indicates an error in the original mapping of this area. If you agree with the information presented by Mr. Thompson, and want to issue a development permit without actually changing the maps, you should send us a letter requesting a floodway revision, without a map change. I am assuming that no fill has been placed on the property and the sur- veyed grid represent conditions which existed in August of 1980 when the flood Insurance Study became effective. While this is a true statement, we made an error in the property description. The correct location that is to be brought out of the flood plain is portions of Lots 6A and 6B in Abstract 1152 ( a total of 25 acres ). This property is directly south of Sandy Lake Road, east of the TP & L powerline easement and west of the Carrollton dam at the Elm Fork of the Trinity River. Box 478 Coppell, Texas 75019 Dear Mayor Brown: Our office received a hand written letter from Mr. Troy D. Glidewell dated June 15, 1983 regarding a request for floodway revision without a map change. (attached) This letter did not identify the area of concern or address any of the technical aspects of such a revision. However, I am guessing that the request is in regard to the conversation I had with Mr. Johnny Thompson (letter attached). If this is the request addressed in Mr. Glidewell's letter, the area of concern is on Sandy Lake Road just west of the Elm Fork of the Trinity River (see attachments). This area was apparently incorrectly identified as being in the lO0-year floodplain. The surveyed grid (attached) shows the property to be above the Base Flood Elevation. If the City of Coppell desires to correct this apparent floodway error, our agency requires two items of information: A letter stating that the city is requesting a floodway revision without an actual map change. This leter should identify the area by attachments or refer to attachments already sent. 2~ The city must adopt a resolution or amendment to the City Floodplain Management ordinance incorporating these floodway changes After the first item is received FEMA will respond with a letter which will state our position with regard to this revision. After a favorable response from FEMA, development permits may be issued by the city if you so desire. Item two must be submitted shortly thereafter. This area of concern is located on the South side of Sandy Lake Road East, and consists of approximately ~75 acres belonging to Mr. Johnny Thompson of Copoell. The area has been shown to be an elevation which is above the Base F~ood Elevation as indicated by the surveyed grid attached. On August 1, 1980, The Federal Emergency Management Agency {FEMA) issued a Flood Boundary and Floodway Map (FBFM) for the City of Coppell, which identified the regulatory floodway for the subject stream (attached), as adopted by the City of Coppell. This letter hereby notifies the City of Coppell that FEMA has no objections to the proposed revision of the flood- way limits as daftned by the attached surveyed §r~&d. In order to effectuate die requested floodway revision, the city of Coppell must provide FEMA with an adopted resolution or amendment to the City floodplain management ordinance incorporating this change. After this requirement has been met, the existing floodway alignment may be revised accordingly and the city may issue development permits as long as other local requirements are met. It is our understanding that the project does not require a map revision so no changes will be made in the FBFM at this time. Also, it is a requirement that the City must enforce the adopted floodplain management measures to ensure continued eligibility to participate in the National Flood Insurance Program. Coppell, therefore, must enforce the regulations including the. proposeo~ revision to the ordinance after adoption by the City.
