Dear Bobby:
On March 30. 1995. the City received a hand-sketched drawing showing a relocated sidewalk
and the existing landscape in the City's right-of-way. Based on our calculations, it took
approximately three weeks to receive this information. The City had tried to impress upon you
that this was of a critical nature, however, the responsiveness from your side has been less than
adequate.
By virtue of this letter, please be advised that all building permits in the River Ridge Subdivision
are being held up at Building Inspections. A copy of this letter will be forwarded to that
department. The City wishes to be very clear in the fact that we have tried to work with you.
and as vet have been unsuccessful in obtaining a satisfactory solution to the situation to satisfy
both the City and your concerns. Therefore. the City respectfully requests that the landscape
areas be constructed as originally approved by City Council and approved by City Staff in the
review of the construction plans.
As an informational note. what was submitted shows not only landscaping in the City's right-of-
way. it also shows a four-foot sidewalk adjacent to the curb. The minimum sidewalk adjacent
to the curb is five foot. It also shows a substantial amount of the landscape, probably up to
50~. actually located on private property. The City was very clear that one of our main
concerns was the tact that if the landscape remained in the City's right-of-way, then who would
be maintaining it on a long-term basis'? Our past experience with items in the City's right-of-
way is that homeowners eventually request the City to maintain those items because they are in
the City's right-of-way.
Iarn sorry for the inconvenience that this may cause you or 3'our builders, however. I think that
you are well aware that this is not a situation the City created. This situation was created by
the construction of this subdivision. The approved plans clearly show the landscaping should

be contained within the five-foot area. and that is not what was constructed in the field. So
again, just so there is no misunderstanding, the following items are being conveyed:
1. Ali building permits in the River Ridge Subdivision are being withheld.
2. Because an inadequate solution has been submitted, the landscaping should be removed
and constructed as per the approved plans.
If it is still you opinion that a workable solution can be arrived at. the City is always willing to
listen. However. until a solution is arrived at. accepted by the City. and initiated in the field.
the permits will be withheld for River Ridge.
