Dear Mr. Berg:
Your request to place fill material and drainage structures with concentrated storm drainage
water flows on a portion of TU ElectriCs right-of-way west of and adjacent to the proposed
River Ridge Addition in the City of Coppell has been reviewed by our engineering and
operations departments.
The fill material that is in place exceeds the area from the initial request made to Tim Brancheau
of our Farmers Branch office. Unless maintenance responsibilities of the subject area are
removed from TU Electric, the fill material will not be allowed to remain.
TU Electric will not allow storm water to be discharged in the manner shown on the plans
submitted. The drainage must be diverted to keep water from eroding, standing or pooling in
and around existing tower foundations. This diversion, in a southerly direction to an existing
drainage area to the south of the subject property, will be at your sole cost and expense. These
plans should be developed by you and submitted to this office for review and approval.
To remedy the above encroachment and drainage problem, TU Electric proposes that the fee
ownership of the fill area, from the toe of the slope to the existing property line, be purchased
by you at a cost of 50% of adjacent Tax Appraisal District land values or approximately
$5,000/per acre.
You will be responsible for all cost associated with this proposed sale, (i.e., survey, deed
preparation, closing, etc.).

If you are agreeable to the above, please so indicate with your signature below and return one
copy of this letter to this office. Upon receipt of this letter, I will route the request to sell
subject property for management approval. This process will take approximately four weeks.
