RE: Bethel Road - Fire Hydrants and Abandoned Manhole
Dear Mr. Davis:
I have been informed that you have requested that Champion Partners address a few non-
compliant issues with city utility fixtures in Bethel Road. It is my understanding that there are
two or three fire hydrants that are too low, perhaps as a result of the City's most recent efforts to
improve the paved surface of Bethel Road, which Champion substantially funded. I would think
that City engineering services would have previously required its contractors to make these
modifications had they been critical in nature. There is additionally an existing manhole that has
been abandoned that you are requesting we remove.
I am unsure as to why such modifications within the newly dedicated City right-of-way are the
responsibility of Champion Partners. These pre-existing conditions reasonably appear to be a
City issue. I further understand that you may not allow us to obtain all of our final approvals
until we have completed these Bethel Road concerns. In as much as this work will require a
contract change order, I am asking that you please provide me with a written basis for
Champion's responsibility to correct these pre-existing conditions. Furthermore, it is our
understanding that all of this will be demolished and reconstructed with the Bethel Road
improvements scheduled for next year.
We are certainly prepared and willing to move forward with these modifications should they
reasonably be our responsibility. To further enlighten us on this matter would be greatly
appreciated.
