Subject: Grade Slope at Creekview Drive Right-of-Way
Duke Realty Services Limited Partnership (Duke Realty) is currently in the process of
receiving all final inspections as required for the completion of our new Freeport VII shell
building at 611 Royal Lane. It has been brought to our attention that Larry Davis, with
the Coppell Engineering Department, has indicated that the current grades in the right-
of-way along the east side of Creekview Drive adjacent to Freeport VII may be too steep
for installation of any future city sidewalks. We have been informed that prior to final
Engineering release for this project that either the grades will need to be modified or a
letter furnished stipulating that the grades would be corrected by Duke Realty at such
time should the need for a future sidewalk arise.
Therefore, this letter shall serve as a written agreement that should the City of Coppell
require city sidewalk installation in the future along the east side of Creekview Drive
adjacent to our Freeport VII building, that Duke Realty will be responsible for reworking
the grades in that adjacent right-of-way area as necessary to accommodate the
sidewalk.
