ST9602-CS000306 FROM TItE DEPARTMENT OF ENGINEERING To: Bob Hagar, City Attorney From: Ken Griffin, P.E., Dir. of Engineering/Public Works ~'~ Date: March 6, 2000 RE: Quit Claim Deed / Denton Tap Road/Bethel Road For several years now the City of Coppell has been working with the engineering firm of USA Professional Services Group Inc., through the State of Texas Department of Transportation (TxDOT) on a federa!ly funded Congestion Mitigation and Air Quality (CMAQ) project at the northwest corner of Denton Tap and Bethel Road. In essence, the project will provide a deceleration lane for south bound traffic on Denton Tap to turn onto Bethel Road in a safe manner. The project requires the acquisition of right-of-way for the construction of the deceleration lane. During property research, USA Professional Services Group, Inc. has provided documents to the City of Coppell which shows right-of-way dedication by the Baptist Foundation in 1973 to the City of Coppell for a 50 foot section of Bethel Road as it intersects Denton Tap Road. However, the information provided shows that there is still a fifteen square foot area that was not dedicated to the City in 1973. TxDOT, along with the firm of USA, is recommending that we purchase that property. This presents a problem. In 1967, the Baptist Foundation purchased a 37.02 tract of land immediately west of Denton Tap and north of the railroad tracks. This purchase in 1967 included what is Bethel Road. It is very clear in the legal description from 1967 that the property went to the north line of the J.A. Simmons Survey. The northern call of the 37.02 acre tract of land states "with said J.A. Simmons Survey north line to a point in the west line of Belt Line Road". In the priorities of survey calls, the description with the north line of the J.A. Simmons Survey overrides the metes and bounds description of that north survey line. In 1973, the Baptist Foundation dedicated property to the City of Coppell that contains Bethel Road immediately west of Denton Tap Road. The north call of that right-of-way dedication states "along the north property line of said Baptist Foundation 37.02 acre tract of land and proposed centerline of Bethel Road". However, as it approaches Denton Tap Road from the west to the east, the north line is then described to have a curve to the right for a distance of about 46.93 feet. This metes and bounds call is slightly different than the metes and bounds call of the property as acquired in 1967. However, in reading the documents, to me it is obvious that the intent of the Baptist Foundation was to dedicate "CITY OF COPPELL ENGINEERING - EXCELLENCE BY DESIGN" approximate 50 feet off the north portion of the property acquired in 1967 to the City of Coppell for right-of-way of Bethel Road. The property immediately north of Bethel Road is referred to as the Alexander tract, as it was purchased by the Alexander Investment Trust in 1990. While it has slightly different bearing calls, it describes a southern boundary as being along the south line of said Edward A. Crow Survey the same being the centerline of Bethel Road. It is obvious by the call in the Alexander tract that the intent of the Alexander tract is to describe an area of !and immediately adjacent to and contiguous with the 50 foot right-of-way dedication in 1973 by the Baptist Foundation to the City of Coppell, relying solely on the adjacent calls not the metes and bounds descriptions, of the two tracts of land and the right-of-way description it is obvious that there is no vacant land between the Alexander tract, the Bethel Road right- of-way and what was the Baptist Foundation property. However, because the metes and bounds description was somewhat different from 1967 to 1973, TxDOT has generated legal documents for us to acquire right-of-way in the amount of 15 square feet from some entity of which there is no ownership. TxDOT, I believe, assumes that the Baptist Foundation still owns the property. But in reading the dedication, it is obvious that the Baptist Foundation's intent was to dedicate off their northern property line, not to retain a sliver of land along the north side of Bethel Road. I had previously informed TxDOT that it was my opinion that there was not a 15 square foot parcel of land to acquire. That if in fact it did exist, we owned it by prescriptive rights. However, they once again have submitted documents for us to pay our 20% share for the acquisition of the 15 square feet of which they still state is owned by the Baptist Foundation. The actual acquisition of the 15 square foot would probably be a minor issue. However, because this is TxDOT federal dollars, they are assigning a $5,000 acquisition cost, in addition to the $60 parcel value, and expecting the City of Coppell to pay 20% of that amount to them for the acquisition of a piece of land of which in my opinion the City already has rights to. That said, I have included the legal description of the 1967 acquisition of !and by the Baptist Foundation, the 1973 dedication to the City of Coppell, the 1990 acquisition by the Alexander Investment Trust and the recent legal descriptions of the 15 square foot by TxDOT. With this memo I am requesting the following items: 1. Upon your review of the information, do you also reach the same conclusion that the 15 foot if it does exists, is not owned by any entity at this point? Or, if it does exist, does the City have prescriptive rights? 2. If you agree with my review, then I am requesting that you prepare necessary quit claim documents for the City of Coppell to acquire the 15 foot, if you deem that necessary. I will be happy to discuss this with you at your convenience.
