Oversized Water Main Reimbursement Agreement with kBQ
Development Corporation
Please find attached an agreement with ABQ Development Corporation for
reimbursement of oversizing of a water main West of Denton Tap that extend
917 feet. The oversize is from a 12" main to a 16" main to service the
projects to the West of Denton Tap.
I believe that there are sufficient funds to cover this $10,575.00 fee out
of the Water and Sewer CIP funds.

OVERSIZE WATER MAIN REIMBURSEMENT AGREEMENT
This Oversize Water Main Reimbursement Agreement is made and entered into as
of the effective date between ABQ Development Corporation ("Developer") and the City
of Coppell, Texas ("City").
W I T N ESS E T H:
WHEREAS, Developer is in the process of constructing through its contractor a
water main in Parkway Boulevard west of Denton Tap Road ~,ithin the corporate limits
of the City of Coppell, Texas; and
WHEREAS, the Developer's needs can be met by the construction of said line as
a 12-inch water main; and
WHEREAS, both Developer and City agree that said line, when completed and
dedicated to the City, would best serve the City of Coppell water system if it were
constructed as a 16-inch water main; and
WHEREAS, City has agreed to reimbt~rse Developer for the cost of oversizing
said line if Developer will complete the line as a I6 inch line;
NOW, THEREFORE, for and in consideration of the mutual covenants herein
expressed, Developer and City hereby agree as follows:
1. The Water Main. The proposed water main which is the subject of this
Agreement and which is to be constructed in Parkway Boulevard west of Denton Tap
Road is more particularly described in the plat attached hereto as Exhibit "B" and is
made a part hereof for all purposes ("the water main").
2. Reimbursement Agreement. Upon the terms and conditions contained herein,
City agrees to reimburse Developer the sum of $10,575.00, said sum being the agreed
oversize reimbursement amount as shown on the letter dated March 8, 1989, to Mr.
Frank Trando, Finance Director of the City of Coppell, a copy of which is attached
hereto as Exhibit "A" and made a part hereof for all purposes. In Consideration of
such payment, Developer agrees to cause said water main to be constructed as a 16-
inch water main.
3. Governing Law and Venue. This Agreement and all of the transactions
contemplated herein shall be governed by and construed in accordance with the laws
of the State of Texas, and Developer and City both irrevocably agree that venue for
any dispute concerning this Agreement or any transaction contemplated herein shall be
in any court of competent jurisdiction in Dallas County, Texas.
4. Counterparts. This Agreement may be executed in any number of
counterparts, each of which shall be an original and all of which shall be deemed to be
one and the same instrument.
5. Effective Date. The effective date of this Agreement ("the effective
date") shall be the 'day of , 1989.
