Box 478 Coppell, Texas 75019 214-462-0022 Dear Mr. Walsh: In response to the three items of inquiry you addressed to the Director of Public Works in your letter dated August 11, 1990, I offer the following: The brick planter which was removed from the southeast corner of Denton Tap and Bethel School Road was an amenity installed by the developer and was to be maintained by the developer. The City of Coppell's policy on maintenance of such amenities is that the Homeowners Association takes over the maintenance when the developer abandons those duties. This planter however posed another dilemma consequently placed the responsibility of maintenance on the adjacent land owner by City ordinance. The ordinance which is also the answer to your second inquiry states that the property owner adjacent to any street or alley right-of- way is responsible for maintaining up to 15 feet outside their property line. Please note that I have attached a copy of the letter City staff submitted to Ms. Bellington several months back advising the Homeowners Association of Staff's recommendation as well as the result of our consulting engineer's review. The street lights on the bridge on Bethel School Road were previously the responsibility of the Parks Division and have been reassigned to the Streets Division for maintenance.
