Shadowridge P1-3-CS 890123January 23, 1989 TO: FROM: RE: Alan Ratliff, City Manager Steve Goram, Director of Public Works Subdivision Entry Features - Shadow Ridge The features referenced above and depicted on the attached exhibits are of great concern to those residing in the subdivision. On occasion Public Works is contacted due to the need for maintenance of these features. That maintenance for the most part has been to remove weeds, replace light bulbs, or repair the irrigation systems. This has been kept to a minimum because the features are located on private property outside the road right-of-way. The features were installed in 1984 prior to the Streetscape plan, which established the criteria for the maintenance of the features, the group responsible for it, and the design, approval of the features. The Developer installing these is not the current one and due to the non-existent plan, the features were not well constructed, multiplying the deterioration, process taking place now. It is now time to ask that these features be addressed by Centex as the property owner. The platting of one of these features within Shadow Ridge Phase IV led to a discussion centered on their future. Steve Stolte of Centex did not wish to provide maintenance either through the company or a homeowners association. He said a dedication of the features to the City or an easement for maintenance purposes would be considered. The primary objection of staff to this is the proximity of a possible home site to the feature and a precedent set committing the City to more maintenance and future dedication of these in other areas to the City. The actions desired by staff would be the relocation of control mechanisms, service lines for utilities and dedication of these to the City in those areas found within the right-of-way by the Developer at their companies expense. Through this the landscaping, bridge lights, and controlling mechanisms for irrigation, lighting would remain to provide the identity the residents wish to preserve of their subdivision. To this cause Mr. Bill Hiser, Mr. Michael Walsh, and Mr. Dana Carpenter have regularly contacted Public Works for assistance as previously mentioned. This situation is complex due to the homeowners wishing to maintain portions of the features, the City obligated for maintenance of the medians and Centex's desire to remove any feature committing them to a long term preseence on this area. An emotional, if not political, solution could result pitting the residents against, developer and possibly city into some negative dialogue in order to attain their position of preserving the feature. Steve Stolte's response to this is that upon completion of the home building, these are customarily removed anyway, but due to circumstances unknown to him they have remained on this project becoming a fixture of the subdivion's community. In our own review and assessment of the interest of the City are best served through the course of action where any City maintained item falls on public property (right-of-way).
