Box 478 Coppell, Texas 75019 214 - 462 - 0022 Dear Mr. Langford: I dropped off 8-1/2 x 11" xerox copies of the "As Built" plans to your office the morning of December 28, 1988. As we have discussed with Steve Stolte, Mr. Gilbert L.Welsh has indicated that there is a clear responsibility for drainage by Shadow Ridge Estate, 2nd Increment, of the rear portion of lot(s) that front on "K" Street more particularly the Gilbert H. Welsh lot (412 "K" Street}. Mr. Welsh further states that the contours of the land while flat in nature still drained well toward the north and northwest before Shadow Ridge Estates, 2nd Increment was built. The "As Built" drawings appear to confirm that assertion. The drainage area plan (copy of part attached) indicates that the Spanish Moss Court Watershed encompasses not only the lots within the development but some 8-10 feet outside of the development's property line. That appears to indicate that the flow of water from those "K" Street lots should be accommodated in the drainge plan of the Shadow Ridge Estates, 2nd Increment subdivision. As I visited with you and Steve Stolte, I tried to have you become sensitive to Mr Gilbert L. Welsh's circumstances and situation and we seek from you, as a good neighbor, a resolution to the situation is an expeditious manner as possible for Mr. Welsh. Enclosed is a packet of information transferred to me in September of this year when I work with Mr Ron Fart, City Building Inspector, and Tom Lych of your company at the request of Mr. Farr. You recently mentioned that someone in Public Works was consulted and things were worked out a while back. I am not aware of any activity other than the enclosed information just mentioned. Please provide me with copies of any other agreements or "As builts" etc. not included here. continued...2 -2- I would like to continue to work toward a practical solution reGardinG this situation with you and as of our last contact you were §oin§ to search for the information you have, similar to what I have enclosed, if not the same. During the last rain fall, water ponded with some depth in Mr. Welsh's back yard in and around the fence separating the lots and at some distance from the fence. While, as a professional employed for the City of Coppell, I can not totally confirm Mr. Welsh's statements regarding the drainage prior to development; the information available to me as enclosed appears to provide some relatedness of your subdivision to the drainage of Mr. Welsh's lot. We look forward to your continued investigation of the matter and review of the situation so that you can get back to me somewhat immediately in hopes that you can provide or resolve this matter, acceptable to both parties. We appreciate your attention to this matter and cooperation even though the situation did occur before your working in this development. Box 478 Coppell, TX 75019 Re: Kaye Street Drainage Improvements Dear Mr. Ratliff: We have completed our review and follow-up on the drainage improvements on the lots along Spanish Moss which were impacting the Kaye Street residents. Per the City's request, the owners have re-graded lots 44 through 51 to accommodate the Kaye Street residences. These lots were graded to drain from back to front (ie., South to North) beginning from the lowest point of adjoining property lines with .Kaye Street. We would like to point out that these improvements address drainage at the adjacent property line. Off-site problems such as low spots on a Kaye Street re$ident's property would be their responsibility. We have forwarded this information to Dale Jackson for filing, noting that future construction activities should be reviewed with respect to maintaining positive drainage. These lots have been graded to drain from the back to the front. In reviewing the information furnished, it appears that positive drainage has been established. However, we would like to point out that any proposed construction be reviewed with sensitivity to work (such as fence building across these swells) which may impede drainage.
