Dear Mr. Jackson:
I am writing this letter to confirm our telephone conversations of Friday, January 22 and
Monday, January 25, 1993. The purpose of our conversations on those dates was to
discuss what actions would be taken to correct the grading problems along the com-
mon property lines between your client's and my client's land. On Friday I called the
general contractor of the school project and requested a price to haul in and grade 500
cubic yards (quantity supplied by your letter dated January 20) of dirt along the north
side of the school building. This would allow this area to drain properly according to our
grading plan. The general contractors called me on Monday with the price which I
relayed to you in our Monday conversation. This price was $3,600.00. At that time I in-
dicated to you that the school district needed to know an answer from your client by
Wednesday noon as to whether or not they were going to pay the $3,600.00. You indi-
cated that you would get in contact with your client. This information was needed by
Wednesday as this decision was delaying the general contractor since Friday, January
22. T.U. Electric has indicated that they will not set any switch gear pads on the ground
until the grade at the area is resolved. Without T.U. Electric doing their work, permanent
power cannot be brought into the building. The general contractor is needing power to
start the mechanical equipment in order to move air to maintain the quality of certain
finishes which are needing to be installed. Any further delays could result in the general
contractor adding on additional costs to the price of $3,600.00. In order to keep these
costs down I am directing the general contractor to proceed with grading operations at
the switch gear pad locations so that permanent power may be installed as soon as
possible. This will still leave the majority of the area in question ungraded at this time.
Please notify me by the first of next week if your client is willing to pay the $3,600.00 to
correct the hardship which has been placed on my client by your grades not allowing
the water to flow properly off of my client's land.
On Wednesday I indicated to you that I would need to contact the City of Coppell in or-
der to keep them informed of what is going on and if they could help resolve this situa-
tion.
