To whom it may concern:
Enclosed is a request for a Specific Use Permit to operate a
Snow Cone business in the Town Oaks Centre of Coppell. Our
request also includes variances from the city which would
allow us to use a portable wooden building during the summer
months each year.
We have taken our request to the planning & zoning
committee who read our application. We have responded to
their recommendations as follows:
Creative Theme - The original building has been
transformed ~-~to a "Ginger-Bread" house, which
includes candy canes, gum-drops, and M&M's resting
in a bed of icing.
Provide new Elevations of the new Theme - Plans have
been prepared by a local, c-~tl-~ie~ architect. The
new plans reflect our attempt to add additional
aesthetic value to the business and to the space
around it.
Provide a Skirt around the building - The building
will be ~kI~-ted across the front with a red-wood
step, across each side with wooden planter boxes
containing lollipops, and across the back with a
strip of painted ply-wood.
Put a Fence around the back of the building - The
new plan incorporates a (6) ft., portable wooden
fence that will fully enclose the rear of the
building, the outdoor freezer and the waste
container.

Secure bathroom facilities, in writing -A letter is
enclosed from a tenant in the center, allowing
our employees to use their bathroom facilities.
Modify the permit to include a lenqth of time -
Although zoning of property can only be changed by
council action, we have suggested a provision which
would require the we re-apply for a "Snow-Cone"
Permit every year.
Since meeting with the Planning and Zoning committee, we
received a letter from Dale Jackson, the City Building
Official, concerning the city's sign ordinance. We have
incorporated his recommendations into our new plan.

Dear Kevin:
As you suggested, we have written Dale Jackson, inspector
with the city of Coppell, concerning several issues which we
discussed at an earlier meeting. We felt that these issues
were important and needed to be addressed before our
application reached the Planning and Zoning committee.
Unfortunately, as was explained over the telephone last week,
Mr. Jackson's office is presently understaffed. For this
reason, he has not been able to address these issues
directly.
We have ~ut together the following requests based on
information that has been collected from members of your sub-
committee and members of the Univest Development Corp.,
which owns the property.
Our request for Specific Use Permit is for the area located
in the TownOaks Shopping Centre, at Sandy Lake Rd. and
Denton Tap. Inside this shopping center, at the north end
facing Sandy Lake Rd., lies an area, 15 ft. by 15 ft.,
originally designated as a landscape area. This area,
located in the final row of parking, next to Sandy Lake Rd.,
is a problem area for traffic and does not provide any
additional parking or landscape for the center.
Our intention is to operate a snow cone business on a
seasonal basis within the center. The following issues are
relevant for our situation:
1. Parking
Apparently, when the center was originally developed, Univest
provided more parking spaces than were required by code. I
have not been able to find out how many additional spots
there were; However, I can say by experience, our business
will only require from (5) to (6) spaces at a time during the
busiest times of the day.
2. Temporary Building
We realize from conversation between your department and the
inspection department that we will be required to seek a
variance to place a temporary building on this location. We
are formally requesting this variance at this time.
3. 80% Masonry Requirement
Also, since this building is temporary, it would not be
feasible to brick its exterior. For this reason, a variance
from masonry exterior would be required so that we may remove
the building at the end of each season.
4. Landscape Dedication
Since the area was originally dedicated as landscape, we
request that the building be allowed to be placed on this
spot on a temporary basis. This spot can be returned to its
present condition when the permit expires.
5. Electric Service
As discovered through conversation with your committee,
electric service will be provided by TU Electric. We are in
the process of contacting them about arranging a utility pole
and meter for the building.
6. Signage
We have discussed with your committee about the size and
location of our signage. According to Mr. Jackson, as long
as the signs do not exceed the size of the exterior walls of
the building, he did not see any problems with reference to
code.
We must indicate to your committee and to each committee
following, that we are very flexible in our requests. We are
open to any recommendations and/or concerns these committees
may have. We realize; However, that timing is critical.
Even as the process stands, the earliest approval would be
mid-May. This would only allow us a few weeks to have the
building constructed, delivered, and set up. We look forward
to discussing these matters with in further detail.

Dear Mr. Jackson:
This letter is a follow up of our conversation on Wednesday,
April 5, 1989 concerning the use of a temporary building in
the TownOaks Centre of Coppell. The building will be used
from April to August each year to sell snow cones from. Per
request from Russell Doyle, city engineer, I have completed
an application for Specific Use Permit and paid the
associated fees. Accordingly, I have attended the
subcommittee for the P & Z chaired by city consultant, Kevin
Peiffer with Gin & Associates. It was Kevin who suggested
that I contact you concerning several variance requests he
thought I may need to operate my business from this building.
1. Available Parking
A major concern of the subcommittee was sufficient parking
space once the building has been set. According to committee
members, it was understood that the center was developed with
additional space up and over their requirement. I need to
find out how many additional spaces there are.
2. Temporary Building
This issue will be addressed for several reasons. First,
since the business is seasonal and closed for more than half
the year it does not appear appropriate to add additional
empty lease space to the area. Second, the amount of initial
expense required in this kind of investment would eliminate
any financial opportunity for myself, or the center.
3. (80%) Masonry Requirement
Since the building is temporary, masonry siding would not be
practical. A variance would be required.
4. Landscape Dedication
The location of the building (see attached exhibit "A") is
requested for TownOaks Centre, located at Sandy Lake Rd. and
Denton Tap (Minyards). Inside this center, near the Sandy
Lake Rd. entrance, lies a landscape area. This area (15' X
15' ') is located within the parking lot and currently acts
as a mud hole for traffic in the center. Our proposal is
that the city would allow the issuance of a Specific Use
Permit for this area. We would then be allowed to set a
building in this area between April and August, each year.
We need to know if this location would fit into the landscape
requirements for the center, or if another variance would be
required.
5. Electric Service
The only utility that our business would require is
electricity. I have visually inspected the site and noticed
that a power line runs down the south side of Sand~ Lake Rd.,
just a few feet from this location. We would require a
service pole to be set adjacent to the power pole so that a
meter could be installed by the local power company. Do you
see any problems with this request?
6. Siqnaqe
Our building is 8' X 12' X 10.5'. The side walls are 12'long
and 8.5' high. Our signage is unlighted and mounted on a 4'
X 8' plywood covered with a matching size piece of plexi-
glass. The sign is permanently attached to the center of the
exterior side wall (see photographs, exhibit "B"). Do you
recognize any problem with these two signs, or any of the
menu signs appearing in the attached photographs.
I am seeking this information to be presented to Kevin
Peiffer for his P & Z agenda. Our request is scheduled to
enter the next P & Z committee meeting. My deadline with Mr.
Peiffer is next Wednesday morning, April 12, 1989. I need a
response on these questions Tuesday, April 11, if possible.
I understand your personnel.limitations; However, please
understand that my request is a timely one. A month delay at
this point would virtually eliminate the opportunity of
openin~ the business this year. Please call me if your see
there ~s going to be any delays.

Dear Mr. Burk:
I have just recently reviewed the information you sent me. I
apologize for not getting back with you prior to April 12. The
only question I have, concerning the information sent, involves
proposed signage for the building. It appears that you may have
misunderstood City regulations governing the size of attached
signs. Attached signs are limited to a maximum size that is
directly related to the lineal frontage of the building. For
example, if the lineal frontage of your building is 8 feet, the
maximum size of the sign is 8 square feet. If signs are located
on separate facades of the building, the size of the sign can be
double. A maximum of 16 square feet of signage can be installed
if at least 2 signs are installed on separate facades.
For your information I have attached a copy of the Sign Ordinance
that regulates attached signs.

Dear Mr. Burk:
Per your request, I would like this letter to serve as an
admission of your intent to set up a ground lease on the
northern most property as indicated in the exhibits
provided on the land owned by Univest-Coppell Village,
Inc., better known as TownOaks Shopping Centre.
As I indicated to you previously, it will be necessary for
you to gain the necessary permits from the municipal
authorities that regulate your industry before we can
consummate the final details of a ground lease. It is our
intention to attempt to consummate a ground lease for the
Summer months for your Slice of Ice business. The
stipulations regarding this obviously are the acceptance
by the municipal authorities, as well as the conforming
architectural designs to your building that will match our
specifications and requirements for TownOaks Centre.
You have our permission to apply for such permits from the
municipal authority based on the stipulations mentioned
above. We cannot, however, take responsibility for any
actions of the City of Coppell or the County of Dallas in
reference to this matter.
