On February 6, 1996, five bids were received and opened for the 1996 Pavement Replacement
Program. The low bidder was Abcon Paving. Abcon Paving has since completed that project.
However, the contract with Abcon Paving included provisions for the City Council to extend the
contract for a one-year period with a maximum number of four extensions. The contract also
provides a mechanism for the contractor to request a price redetermination based upon direct cost
increase, wage and labor rate increase, etc. Attached to this agenda item is a letter from Abcon
Paving requesting a price redeterrnination in the amount of $9.00/per square yard. This is based on
an increase in concrete and labor costs in the past year. The $9.00/per square yard will increase the
total price per square yard to $52.50. One year ago the next low bidder to Abcon Paving was at
$52.40. It is safe to assume that Abcon Paving would still be the low bidder if the project was
competitive]y bid.
Because Abcon Paving was responsive and performed an excellent job for the City of Coppell in
1996 and because their price remains competitive, if not lower than what an open bid would provide
to the City of Coppel], my recommendation is for the City Council to extend Bid Q-0196-0] in an
amount not to exceed $65,000 for the 1997 Pavement Replacement Program.

A PRICE redetermination may be considered by the City only at the anniversary date of the Contract and~
shall be substantiated in writing (i.e., Manufacturer's direct cost, postage rates, Railroad Commission
rates, Wage/Labor rates, etc.). The Bidder's past history of honoring Contracts at the bid price will be
an important consideration in the evaluation of the lowest and best bid. The City reserves the right to
cept or reject any/all of the prtce redeterm,naUon as it deems to be m the best interest of the City.
DELIVERY: All delivery and freight charges (F.O.B. City of Coppell) are to be included in the bid
price.
DELIVERY TIME: Bids shall show number of days required to place goods ordered at the City's
designated location. Failure to state delivery time may cause bid to be rejected. Successful Bidder shall
notify the Purchasing Department immediately if delivery schedule cannot be met. If delay is foreseen,
successrid Bidder shall give written notice to the Purchasing Agent. The City has the right to extend
delivery time if reason appears valid. Successful Bidder must keep the Purchasing Depa~h,.ent advised
at all times of the status of the order.
CONFLICT OF INTEREST:. No public official shall have interest in this Contract, in accordance with
Vernon's Texas Codes Annotated, Local Government Code Ti~e 5. Subti~e C, Chapter 171.
ETHICS: The following sections of the Texas Penal Code shall be enforced when doing business with
the City of Coppell.
