HISTORY: This property gained site plan approval approximately one year ago
and currently contains a 25,000 square foot retail building with a
variety of business uses. Several SLIP's have been granted over the
last several months, and thin request follows that pattern.
TRANSPORTATION: Denton Tap Road is a P6D 6 lane divided thoroughfare built to
standard in a ll0-foot r.o.w.
SURROUNDING LAND USE & ZONING:
North- vacant parcel, the office building; "TC" Town Center
South - bank building; uTC" Town Center
East - city building (Justice Center); uTC" Town Center
West - residential across Denton Tap; "PD SF-9" residential
COMPREHENSIVE PLAN: The Comprehensive Plan shows the property as suitable for
neighborhood retail uses.

DISCUSSION: This is a request to allow a juice store to operate in the Eleanor Square
shopping center, just west of Town Center. Most of the juices are fruit
based, and are composed of a variety of ingredients including ice cream,
honey, yogurt, and so on. Signage proposed for the use meets the
requirements of this center, and no negative comments were received
from any of the reviewing departments. Planning's only concern relates
to the parking situation at this center. According to the property
manager, this site has 1:56 parking spaces. The proposed juice store
would require 15 spaces and adding that number to the existing required
parking count results in 6:5 spaces being reserved for restaurant/food
uses. Assuming the center leases 100%, only retail uses can be placed in
the remainder of the vacant space, as 91 parking spaces will be required
for those potential retail uses. What this says is no more restaurants can
occupy the center without adding additional parking. The leasing agent
understands that fact, and we comment just to state our position if
another restaurant use were proposed here.
RECOMMENDATION TO THE PLANNING AND ZONING COMMISSION:
Staff recommends approval of the juice store subject to the following conditions:
1. Hours of operation are from 7a-gp M-F; 7a-8p on Sat.; not open on
Sunday
2. Signage will comply with colors allowed in the shopping center.
3. Parking will meet the zoning ordinance requirements

1. A copy of the changes were faxed to the property owner's real estate agent,
Preston Whisenant, Tmnswestem Property Company (fax #972-991-4247) on
May 3.
2. The proposed hours of operation are:
Monday - Friday 7:00 am - 9:00 pm
Saturday 7:00 am - 8:00 pm
3. The color of the channel letter sign will be white.
4. Attached is a copy of the Town Center approved site plan.
5. The zoning change request sign will be posted in the window on Thursday,
May 6th, to remain through June 8th.
